Justice S.S.SATHEESACHANDRAN\n\n Dated :15\/01\/2010\n\n O R D E R\n              S.S.SATHEESACHANDRAN, J.\n                  -------------------------------\n              W.P.(C).NO.29822 OF 2009 ()\n                -----------------------------------\n        Dated this the 15th day of January, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>      The writ petition is filed seeking mainly the following<\/p>\n<p>reliefs:\n<\/p>\n<\/p>\n<blockquote><p>         i. to issue a writ of prohibition or any other<br \/>\n         appropriate      writ,   direction    or   order<br \/>\n         restraining       the      Munsiff&#8217;s      Court,<br \/>\n         Karunagappally from proceeding ahead in<br \/>\n         any     manner      in   E.P.No.312\/2004       in<br \/>\n         C.S.No.492\/2003       until  the    disposal   of<br \/>\n         Exts.P3 and P3(a) by the District Court,<br \/>\n         Kollam.\n<\/p><\/blockquote>\n<blockquote><p>         ii. to issue a writ of mandamus or any other<br \/>\n         appropriate      writ,   order    or    direction<br \/>\n         directing the District Court, Kollam to<br \/>\n         dispose of Exts.P3 and P3(a).\n<\/p><\/blockquote>\n<blockquote><p>         iii. to stay all further execution proceedings<br \/>\n         in C.S.No.492\/2003 before the Munsiff<br \/>\n         Court, Karunagappally until the disposal of<br \/>\n         the writ petition.<\/p><\/blockquote>\n<p>      The learned counsel for the respondent submits that the<\/p>\n<p>appeal preferred against the decree passed in O.S.NO.492 of<\/p>\n<p>2003 has been dismissed as time barred. An affidavit has also<\/p>\n<p><span class=\"hidden_text\">WPC.29822\/09                    2<\/span><\/p>\n<p>been filed by the respondent. The learned counsel for the<\/p>\n<p>petitioner submitting that he intends to prefer a second<\/p>\n<p>appeal, seeks for an order to keep in abeyance the delivery of<\/p>\n<p>the property, to have a breathing time to enable him to<\/p>\n<p>present such appeal. The learned counsel also requested for a<\/p>\n<p>direction for issue of the copy of the order passed by the court<\/p>\n<p>below dismissing his appeal A.S.No.320 of 2009 on the file of<\/p>\n<p>the District Court, Kollam.      Considering the submissions<\/p>\n<p>made, I direct the District Judge, Kollam to issue a copy of the<\/p>\n<p>judgment\/order in A.S.No.320 of 2009, if applied for, within a<\/p>\n<p>period of two weeks from the date of receipt\/production of a<\/p>\n<p>copy of this judgment. The execution court, Munsiff Court,<\/p>\n<p>Karunagappally is also directed to keep in abeyance the<\/p>\n<p>delivery of the property for a period of three weeks from the<\/p>\n<p>date of this judgment.
