Justice S.S.SATHEESACHANDRAN\n\n Dated :03\/06\/2009\n\n O R D E R\n                   S.S.SATHEESACHANDRAN, J.\n                   -----------------------------------\n                   W.P.(C).No.13841 of 2009 - O\n                    ---------------------------------\n                Dated this the 3rd day of June, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>      This writ petition is filed under Article 227 of the<\/p>\n<p>Constitution of India seeking the following reliefs:<\/p>\n<blockquote><p>         &#8220;i)  To call for the records leading to Exts.P1 to P7<\/p>\n<p>         and to issue appropriate orders setting aside Ext.P6<\/p>\n<p>         order and confirming Ext.P4 order passed by the<\/p>\n<p>         learned Sub Judge in Ext.P3 proceedings.<\/p>\n<\/blockquote>\n<blockquote><p>         ii)  Declare that Ext.P4 order is legally sustainable<\/p>\n<p>         and the modification passed by the learned Sub Judge,<\/p>\n<p>         Pala as per Ext.P6 is legally unsustainable&#8221;.<\/p><\/blockquote>\n<p>      2.    Petitioner has initiated insolvency proceedings as<\/p>\n<p>I.P.No.3\/2009 to declare the 1st respondent as an insolvent<\/p>\n<p>before the Sub Judge, Pala. Petitioner also moved an application<\/p>\n<p>under Order XXXIX Rule 1 CPC to restrain the respondent from<\/p>\n<p>slaughter tapping the rubber trees in his property which was<\/p>\n<p>separately scheduled. The learned Sub Judge initially passed an<\/p>\n<p>ex-parte order of injunction. Respondent on entering appearance<\/p>\n<p>filed objection to this I.A. contending that the property scheduled<\/p>\n<p>W.P.(C).No.13841 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>was already under order of attachment before judgment in a suit<\/p>\n<p>filed by the very same petitioner. After hearing both sides, the<\/p>\n<p>learned Sub Judge passed Ext.P6 order modifying the order of<\/p>\n<p>injunction permitting the respondent to slaughter the rubber<\/p>\n<p>trees, but prohibiting him from cutting and removing other trees<\/p>\n<p>in his property. Impeaching the correctness of that order, the<\/p>\n<p>petitioner has filed the above writ petition invoking the<\/p>\n<p>supervisory jurisdiction of this Court under Article 227 of the<\/p>\n<p>Constitution of India submitting that the order is not proper and<\/p>\n<p>legal.\n<\/p>\n<p>      3.   I heard the counsel on both sides.\n<\/p>\n<p>      4.   A preliminary objection is raised by the learned<\/p>\n<p>counsel for the respondent that the writ petition is not<\/p>\n<p>maintainable as the petitioner has alternative efficacious remedy<\/p>\n<p>by way of statutory appeal under Section 79 of the Insolvency<\/p>\n<p>Act. Resisting that challenge learned counsel for the petitioner<\/p>\n<p>invited my attention to Ext.P7 judgment passed by this Court in<\/p>\n<p>an insolvency proceedings.     I find that Ext.P7 judgment was<\/p>\n<p>passed by this Court in respect of a proceedings where the<\/p>\n<p>W.P.(C).No.13841 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>procedural matter was involved and not a substantive right of a<\/p>\n<p>party. The application moved under Order XXXIX Rule 1 CPC by<\/p>\n<p>the petitioner for injunction is not one concerning the procedure<\/p>\n<p>but depend upon the substantive right of the petitioner to claim<\/p>\n<p>such an injunction against the respondent who is sought to be<\/p>\n<p>declared as insolvent. Section 79 of the Insolvency Act reads<\/p>\n<p>thus:\n<\/p>\n<blockquote><p>               &#8220;79. Appeals:-\n<\/p><\/blockquote>\n<blockquote><p>               (1)   The debtor, any creditor, the receiver or<\/p>\n<p>         any other person aggrieved by a decision come into or<\/p>\n<p>         an order made in the exercise of insolvency jurisdiction<\/p>\n<p>         by a Court subordinate to a District Court may appeal<\/p>\n<p>         to the District Court and the order of the District Court<\/p>\n<p>         upon such appeal shall be final:\n<\/p><\/blockquote>\n<blockquote><p>               Provided that the High Court, for the purposes of<\/p>\n<p>         satisfying itself that an order made in any appeal<\/p>\n<p>         decided by the District Court wasaccording to law, may<\/p>\n<p>         call for the case and pass such order with respect<\/p>\n<p>         there to as it thinks fit;\n<\/p><\/blockquote>\n<blockquote><p>               Provided further that any such person aggrieved<\/p>\n<p>         by a decision of the District Court on appeal from a<\/p>\n<p>         decision of a subordinate Court under section 4 may<\/p>\n<p>         appeal tot he High Court on any of the grounds<\/p>\n<p>         mentioned in sub-section (1) of section 100 of the<\/p>\n<p>W.P.(C).No.13841 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>         Code of Civil Procedure, 1908.\n<\/p><\/blockquote>\n<blockquote><p>\n         (2)   Any such person aggrieved by any such decision<\/p>\n<p>         or order of a District Court as is specified in Schedule<\/p>\n<p>         I, come to or made otherwise than in appeal from an<\/p>\n<p>         order made by a Subordinate Court, may appeal to the<\/p>\n<p>         High Court.\n<\/p><\/blockquote>\n<blockquote><p>\n         (3)   Any such person aggrieveda by any other other<\/p>\n<p>         order made by a District Court otherwise than in<\/p>\n<p>         appeal from an order made by a subordinate Court<\/p>\n<p>         may appeal to the High Court by leave of the District<\/p>\n<p>         Court or of the High Court.\n<\/p><\/blockquote>\n<blockquote><p>\n         (4)   The periods of limitation for appeals to the<\/p>\n<p>         District Court and to the High Court under this section<\/p>\n<p>         shall be thirty days and ninety days, respectively.<\/p><\/blockquote>\n<p>     5.    There cannot be any doubt as against the order<\/p>\n<p>passed under Order XXXIX Rule 1 CPC in invoking proceedings<\/p>\n<p>the remedy is by way of an appeal as provided under Section 79<\/p>\n<p>of the <a href=\"\/doc\/207943\/\">Insolvency Act. In Narayana Panicker v. Kunju Pennu<\/p>\n<p>and Others<\/a> (1978 KLT 311) it is made clear that Section 79 of<\/p>\n<p>the Insolvency Act is exhaustive as regard right of appeal, forum<\/p>\n<p>of appeal, the subject of appeal and the period of limitation<\/p>\n<p>W.P.(C).No.13841 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                               5<\/span><\/p>\n<p>within which the appeal has to be preferred. The petitioner is<\/p>\n<p>having a right of statutory appeal to challenge Ext.P6 order<\/p>\n<p>before the appropriate forum and the writ petition is therefore<\/p>\n<p>found to be not entertainable. Without prejudice to the right of<\/p>\n<p>the petitioner to prefer an appeal against Ext.p6 order as<\/p>\n<p>provided by the Insolvency Act, if so advised, the writ petition is<\/p>\n<p>dismissed.
