No.12371 of 2011\n                  OM PRAKASH YADAV SON OF LATE RAMJI PRASAD\n                                          Versus\n                                THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>2   19.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The   petitioner   being   the   husband   is<\/p>\n<p>                 apprehending his arrest in a complaint case in which<\/p>\n<p>                 cognizance has been taken under Sections 498A and<\/p>\n<p>                 323 of the Indian Penal Code.\n<\/p>\n<p>                              The marriage was performed in the year<\/p>\n<p>                 1999 and the petitioner filed a divorce case in the year<\/p>\n<p>                 2007 when the present case was filed in the year 2010.<\/p>\n<p>                              It is submitted that since, 2003 itself, the<\/p>\n<p>                 complainant is not residing with the petitioner.<\/p>\n<p>                              The petitioner is ready to make payment of<\/p>\n<p>                 Rs. 500\/- per month to the complainant by depositing<\/p>\n<p>                 the same in the bank account of the complainant from<\/p>\n<p>                 May, 2011 by second week of every month.<\/p>\n<p>                              The petitioner will serve the copy of this<\/p>\n<p>                 order to the complainant when the complainant will<\/p>\n<p>                 give bank account number to the petitioner within a<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>             period of two weeks.\n<\/p>\n<p>                       The aforesaid payment will be subject to any<\/p>\n<p>             order being passed in matrimonial or maintenance<\/p>\n<p>             proceedings.\n<\/p>\n<p>                       Considering the aforesaid facts, let the above<\/p>\n<p>             named petitioner, be released on anticipatory bail, in<\/p>\n<p>             the event of his arrest or surrender before the learned<\/p>\n<p>             Court below within a period of 12 weeks from today,<\/p>\n<p>             on furnishing bail bond of Rs. 10,000\/- (ten thousand)<\/p>\n<p>             with two sureties of the like amount each to the<\/p>\n<p>             satisfaction of the learned Judicial Magistrate 1st Class,<\/p>\n<p>             Saran at Chapra in connection with Complaint Case<\/p>\n<p>             No. 1236\/2010, subject to the conditions as laid down<\/p>\n<p>             under Section 438(2) Cr.P.C.\n<\/p>\n<\/p>\n<p>                                          (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Om Prakash Yadav vs The State Of Bihar on 19 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
