JUSTICE R.M.DOSHIT)<\/p>\n<p>\tWith<br \/>\nthe consent of the learned advocates, the petition is taken up for<br \/>\nhearing today.\n<\/p>\n<p>\tThe<br \/>\nsubject matter of this petition is a contract for collection of Toll<br \/>\nTax on National Highway at Samakhiyali, District-Kachchh.\n<\/p>\n<p>\tThe<br \/>\npetitioner who was awarded the contract for collection of the toll<br \/>\ntax filed the above writ petition under Article 226 of<br \/>\nthe Constitution under apprehension that the contract awarded to him<br \/>\nfor the period upto 28th February 2010 may be terminated<br \/>\nprematurely.\n<\/p>\n<p>\tThe<br \/>\npetition has been contested by the respondents. According to the<br \/>\nrespondents-authorities, the petitioner had procured the contract by<br \/>\nmisrepresentation.\n<\/p>\n<p>\tThe<br \/>\npetition is entertained by this Court. By Order dated 24th<br \/>\nApril 2009 made by the Bench comprising Mr. Justice Mohit S.<br \/>\nShah, as he then was &amp; Ms. Justice H.N Devani,<br \/>\nthe petitioner was protected. While granting the interim<br \/>\nrelief, the Court observed,  ..we are of the view that this<br \/>\nis a fit case where interim relief as prayed for, and which was<br \/>\ngranted while issuing notice on 31.3.2009, should be continued till<br \/>\nfinal disposal of this petition.  It is not in dispute that<br \/>\nthe contract is for the period upto 28th February 2010.<br \/>\nNow that the contract period is about to be over, we do not intend to<br \/>\ninterfere in the matter.\n<\/p>\n<p>\tWithout<br \/>\nprejudice to the rights and contentions raised by the parties to the<br \/>\npresent petition, the petition is allowed. The petitioner will be<br \/>\nallowed to continue to collect the toll tax under the contract dated<br \/>\n8th March 2008 upto 28th February 2010 as<br \/>\nagreed. On completion of the contract period, the petitioner will<br \/>\nhand over charge of the toll booth and other materials to the<br \/>\nrespondents-authorities forthwith on 1st March<br \/>\n2010. Rule is made absolute in the above terms.
