BALAKRISHNAN NAIR &amp; V.GIRI, JJ.\n                   -----------------------------\n                      R.P.No.576 OF 2009\n                   -----------------------------\n             Dated this the 31st day of July, 2009\n\n                            O R D E R\n<\/pre>\n<p>                           ~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>      Going by the ground taken and the arguments addressed,<\/p>\n<p>we are of the view that the review petitioner is trying for re-<\/p>\n<p>hearing of the Writ Petition itself.   Whether the building was<\/p>\n<p>completely reconstructed or only an additional construction was<\/p>\n<p>made after the date of the notification of the provision<\/p>\n<p>concerning luxury tax was the dispute considered and decided by<\/p>\n<p>the learned Single Judge. The decision went against the review<\/p>\n<p>petitioner.    It was found that the entire building was<\/p>\n<p>reconstructed. The learned Single Judge also provided that if<\/p>\n<p>the construction is below the stipulated plinth area, that is,<\/p>\n<p>278.70 m2, he can convince the Tahsildar about that and escape<\/p>\n<p>from the liability of paying luxury tax. But, the learned counsel<\/p>\n<p>for the review petitioner is canvassing again for the position that<\/p>\n<p>there was only an additional construction and therefore, luxury<\/p>\n<p><span class=\"hidden_text\">R.P.No.576\/2009                 2<\/span><\/p>\n<p>tax cannot be imposed for the said additional construction, which<\/p>\n<p>has a plinth area below 278.70 m2.\n<\/p>\n<\/p>\n<p>      Having regard to the limited scope of review, we feel that<\/p>\n<p>the above contention cannot be examined in this Review Petition.<\/p>\n<p>Accordingly, it is dismissed.\n<\/p>\n<\/p>\n<p>                             (K.BALAKRISHNAN NAIR, JUDGE)<\/p>\n<p>                                     (V.GIRI, JUDGE)<\/p>\n<p>ps<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Karuvattil Yasir vs Government Of Kerala on 31 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM RP.No. 576 of 2009() 1.
