Mehta.\n                                              ------\n07\/18.04.2011<\/pre>\n<p>           Learned counsel for the appellant at the very outset has cited<br \/>\n                certain decisions in support of his contention. Considering all these<br \/>\n                decisions, it appears that the question involved in this case has<br \/>\n                already been decided by a Division Bench of this Court in Writ<br \/>\n                Petition (S) No.4461 of 2008 and analogous cases decided on<br \/>\n                13th April,2011 holding that the child of second wife is not entitled for<br \/>\n                compassionate appointment.\n<\/p>\n<p>                        The learned counsel for the appellant has placed another<br \/>\n                decision rendered by a Division Bench of this Court which in our<br \/>\n                opinion cannot be applied as appointment on compassionate<br \/>\n                ground is not heritable right as provided under personal law<br \/>\n                governing the person. Therefore, taking into account that inheritable<br \/>\n                right has no application to the present scenario of the case and<br \/>\n                particularly in view of the bar against the contracting second<br \/>\n                marriage as provided in standing order Clause No.26.1.21 of the<br \/>\n                respondent(B.C.C.L.) the applicant was rightly held not entitled to<br \/>\n                the appointment.\n<\/p>\n<p>                        In that view of the matter, we do not think that the decision<br \/>\n                relied upon by the learned counsel would be of any relevance what<br \/>\n                soever in the controversy.\n<\/p>\n<p>                        In that view of the matter we do not think that the appeal is<br \/>\n                liable to be considered.
