PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 25\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tPetitioner<br \/>\nseeks regular bail in connection with the FIR, bearing I-C.R.<br \/>\nNo.198 of 1997, registered with Dani Limda Police Station, for the<br \/>\noffences punishable under Sections-302, 120(B), 201, 202 and 114 of<br \/>\nthe Indian Penal Code, Section-135(1) of the Bombay Police Act and<br \/>\nSections-25(1)(A) and (B) of the Arms Act. The complaint was filed on<br \/>\n23.11.1997. The petitioner, however, could be arrested only on<br \/>\n28.07.2010. The petitioner, therefore, remained absconding for a<br \/>\nperiod of about 13 years.\n<\/p>\n<p>2.\t\tUnder<br \/>\nthe circumstances, the petitioner cannot be expected to come back to<br \/>\nface the trial, if released on bail. Only on this ground, I am not<br \/>\ninclined to accept the request of the petitioner.\n<\/p>\n<p>3.\t\tLearned<br \/>\nCounsel for the petitioner submitted that the other accused have been<br \/>\nacquitted by the trial Court and such acquittals have been upheld by<br \/>\nthe<br \/>\nHigh Court.  This is, however, an entirely different aspect of the<br \/>\nmatter. Since, in the cases of the other accused persons, the<br \/>\ndecisions have been rendered on the basis of the evidence on record.<br \/>\nWhat will be the outcome of the trial against the present petitioner,<br \/>\ncannot be presumed, at this stage.  Only on the ground that the<br \/>\npetitioner was not available to face the trial for 13 long years,<br \/>\nthis application requires to be rejected.\n<\/p>\n<p>4.\t\tOne<br \/>\nof the prime consideration before the Court, while examining a bail<br \/>\napplication shall be, whether the accused, if released, would be<br \/>\navailable for trial.
