C.R. No. 41\/2009, registered with D.C.B. Police<br \/>\nStation, Ahmedabad for the offences punishable under Sections 406,<br \/>\n420, 467, 468, 471, 506[1] and 294[b] of Indian Penal Code, 1860.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>S.V. Raju, learned Sr. Advocate, appearing for the applicants,<br \/>\nsubmitted that the applicants are nowhere involved in the alleged<br \/>\ncommission of offence as alleged in the FIR. Considering the fact<br \/>\nthat the complainant has filed detailed affidavit, wherein, no<br \/>\ngrievance is made out against the present applicants, they deserve to<br \/>\nbe granted anticipatory bail as prayed for in the application.<br \/>\nLearned counsel has also placed reliance on Annexure:C which is a<br \/>\nletter written by the complainant to the Police Inspector, Naroda<br \/>\nPolice Station, wherein, names of the present applicants are also not<br \/>\nmentioned. Considering<br \/>\nthe aforesaid aspect and the FIR which is produced along with the<br \/>\npresent application, prayer, as set out in the application be<br \/>\ngranted. Learned counsel has  placed reliance on the judgment of the<br \/>\nApex Court in the case of <a href=\"\/doc\/981549\/\">Ravindra Saxena v. State of Rajasthan<\/a><br \/>\n[(2010) 1 SCC 684], in support of the submission that even in case of<br \/>\nsuccessive anticipatory bail application, the ratio laid down in the<br \/>\nabove judgment can be considered. Thus, the learned counsel submitted<br \/>\nthat the prayer as set out in the application be granted.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>H.L. Jani, learned  APP, while opposing the application submitted<br \/>\nthat the applicants are facing charge of offences punishable under<br \/>\nSections 406, 420, 467, 468, 471, 506[1] and 294[b] of IPC.<br \/>\nConsidering the role attributed to the applicants and this being<br \/>\nsuccessive  application for anticipatory bail, no discretionary<br \/>\nrelief be granted to the applicants  and the the application deserves<br \/>\nto be rejected out of hand.\n<\/p>\n<p>\tHeard<br \/>\nthe learned counsel for the parties at length and in detail. I have<br \/>\nalso considered the role attributed to the applicants as reflected in<br \/>\nthe  FIR. I have also perused the affidavit filed by the complainant<br \/>\nwherein he has not voiced any grievance against the applicants. I<br \/>\nhave also considered the ratio laid down in the decision of the Apex<br \/>\nCourt referred to herienabove. Considering peculiar facts and<br \/>\ncircumstances, substantial change in the circumstances and the<br \/>\naffidavit filed by the complainant, wherein, he has not voiced any<br \/>\ngrievance against the applicants, I am of the view that the<br \/>\napplicants deserve to be granted anticipatory bail without recording<br \/>\nthe reasons in detail. Hence, the following<br \/>\norder is passed.\n<\/p>\n<p>\tIn<br \/>\nthe event of arrest of the applicants in connection with FIR bearing<br \/>\nI. C.R. No. 41\/2009 registered with D.C.B. Police Station, Ahmedabad<br \/>\nfor the offences punishable under Sections 406,<br \/>\n420, 467, 468, 471, 506[1] and 294[b] of IPC, they<br \/>\nshall be released on bail on executing a bond of Rs.10,000\/- each<br \/>\n[Rupees ten thousand only] with one surety each of the like amount on<br \/>\nthe following conditions that they shall:\n<\/p>\n<p>[a]\tco-operate<br \/>\nwith the investigation and make themselves available for<br \/>\ninterrogation whenever and wherever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at the concerned Police Station on 15th<br \/>\nDecember, 2010 between 9.00 AM to 3.00 PM.\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d]\tat<br \/>\nthe time of execution of bond, furnish their residential address to<br \/>\nthe investigating officer and the Court concerned and shall not<br \/>\nchange their residence till the final disposal of the case or till<br \/>\nfurther orders;\n<\/p>\n<p>[e]\tnot<br \/>\nleave India without the permission of the Court and, if holding a<br \/>\npassport, they shall surrender the same before the Trial Court within<br \/>\na week;\n<\/p>\n<p>[f]\tnot<br \/>\nobstruct or hamper the police investigation and not play mischief<br \/>\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n<p>\tIt would<br \/>\nbe open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>\tThis<br \/>\norder will hold good, if the applicants are arrested at any time<br \/>\nwithin 90 days from today.  The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of their<br \/>\narrest.  Thereafter, it will be open to the applicants to make a<br \/>\nfresh application for being enlarged on bail in usual course, which,<br \/>\nwhen it comes up before the competent Court, will be decided in<br \/>\naccordance with law, having regard to all the attending circumstances<br \/>\nand the materials available at the relevant time, without being<br \/>\ninfluenced by the fact that anticipatory bail was granted.\n<\/p>\n<p>\tWith<br \/>\nthese directions, this application is allowed.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute.
