R.C.KODEKAR, APP for\nRespondent(s) : 1, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tR.C.Kodekar, learned APP appears and waives service of notice of<br \/>\n\tRule on behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\tapplicant &#8211; convict prisoner, who, vide judgment and order<br \/>\n\tdated 30.12.2009 rendered in Sessions Case No.159 of 2007 by the<br \/>\n\tlearned Additional Sessions Judge, Fast Track Court No.3, Palanpur,<br \/>\n\thas been convicted for the offence punishable under Sections 302,<br \/>\n\t201 and 120B of the Indian Penal Code and sentenced to imprisonment<br \/>\n\tfor life, has filed this application praying for suspension of<br \/>\n\tsentence and to release him on regular bail during the pendency and<br \/>\n\tfinal hearing of the above numbered Criminal Appeal.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by Mr. Pravin Gondaliya,<br \/>\n\tlearned Advocate for the Applicant and Mr.R.C.Kodekar, learned APP<br \/>\n\tfor the Respondent &#8211; State of Gujarat.  We have also perused<br \/>\n\tthe impugned judgment and oder convicting the Applicant accused of<br \/>\n\tthe offences punishable under Sections 302, 201 and 120B of IPC,<br \/>\n\tagainst which Criminal Appeal No.27 of 2010 has been Admitted vide<br \/>\n\torder 13.1.2010.\n<\/p>\n<p>On<br \/>\n\tperusal of the record of the case, it is seen that the earlier<br \/>\n\tapplication being Criminal Misc. Application No. 186 of 2010 filed<br \/>\n\tby the applicant for suspension of sentence and to release him on<br \/>\n\tregular bail has been disposed of by a coordinate bench of this<br \/>\n\tCourt vide order dated 13.1.2010, as the learned Advocate of the<br \/>\n\tApplicant in all fairness has not pressed the said application.<br \/>\n\tTherefore, this is a successive bail application only on the ground<br \/>\n\tthat one year has elapsed and the Appeal has not been listed on<br \/>\n\tfinal hearing board.\n<\/p>\n<p>According<br \/>\n\tto us, this is not a change in circumstance.  That apart, on merits<br \/>\n\tof the case, on a perusal of the impugned judgment and order, it is<br \/>\n\tseen that the trial Court has convicted the applicant accused on the<br \/>\n\tbasis of the discovery panchnama of the recovery of the motorcycle<br \/>\n\tof the accused as well as leg of cot (charpai)<br \/>\n\tat the instance of the accused. Therefore, at this stage, it is very<br \/>\n\tdifficult to jump to the conclusion that the impugned judgment and<br \/>\n\torder convicting the applicant accused is erroneous or perverse and<br \/>\n\tany illegality has been committed by the trial Court in convicting<br \/>\n\tthe applicant accused of the offence with which he was charged.\n<\/p>\n<p>\tIn view of<br \/>\n\tthis, since this is a successive bail application and on merits also<br \/>\n\tthe Applicant has failed to make out the case for suspension of<br \/>\n\tsentence and to release him on regular bail during the pendency and<br \/>\n\tfinal hearing of the above numbered Appeal,  the application deserve<br \/>\n\tto be rejected.\n<\/p>\n<p>\tFor the<br \/>\n\tforegoing reasons, application fails and accordingly it is rejected.<br \/>\n\t Rule is discharged.\n<\/p>\n<p>\tNeedless<br \/>\n\tto say that no observation made hereinabove shall be construed as an<br \/>\n\texpression of opinion on merits of the Appeal.
