Therefore departmental proceedings were initiated<br \/>\nwhich resulted in termination of the services of the respondent. The<br \/>\nrespondent therefore raised a dispute which was numbered as Reference<br \/>\n(LCJ) No.289 of 1991 and the Labour Court, Jamnagar passed the award<br \/>\nas stated hereinabove.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned Advocates for the respective parties and perused the<br \/>\nrelevant documents on record. As a result of this exercise, it is<br \/>\nevident that the allegation against the respondent was remaining<br \/>\nabsent from duty, which, in my opinion, do not warrant penalty of<br \/>\ndismissal from service. Therefore the Labour Court was fully<br \/>\njustified in setting aside the order of dismissal. The Labour Court<br \/>\nhas also not granted any back wages to the respondent. Further,<br \/>\nlooking to the seriousness of the misconduct the Labour Court has<br \/>\nimposed a penalty of stoppage of five increments with future effect.<br \/>\nThis penalty is sufficient for the misconduct of the respondent and<br \/>\nit does not require any enhancement.\n<\/p>\n<p>4.\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\nsame is therefore dismissed. Rule is discharged with no order as to<br \/>\ncosts.\n<\/p>\n<p>5.\tThe<br \/>\njudgement and award of the Labour Court shall be implemented within<br \/>\nfour months from today.
