Justice V.GIRI\n\n Dated :12\/05\/2009\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n                  W.P.(C).13526\/2009\n                     --------------------\n         Dated this the 12th day of May, 2009\n\n                     JUDGMENT\n<\/pre>\n<p>      Issue raised by the petitioner in this writ<\/p>\n<p>petition is covered by Ext.P3 judgment of          the<\/p>\n<p>Division Bench dealing with the validity of a sub<\/p>\n<p>clause contained in Government Order restricting<\/p>\n<p>consideration of applications for No Objection<\/p>\n<p>Certificates to schools requiring affiliation to CBSE.<\/p>\n<p>The Division Bench has held that the applications are<\/p>\n<p>eligible to be considered in the light of G.O (MS)<\/p>\n<p>No.18\/88\/G.Edn dated 12.1.1988 ignoring the newly<\/p>\n<p>introduced clause 1 (a) of G.O (MS)No.204\/08\/G.Edn.<\/p>\n<p>dated 15.12.2008 as amended by the subsequent G.O<\/p>\n<p>(MS) 3\/09\/G.Edn. dated 5.1.2009.<\/p>\n<p>2.    In the result, the writ petition is disposed of<\/p>\n<p>directing the first respondent to receive the<\/p>\n<p>petitioner&#8217;s application for issuance of No Objection<\/p>\n<p>Certificate on file and take a decision thereon in the<\/p>\n<p>light of the directions issued by the Division Bench in<\/p>\n<p>W.P.(C).13526\/2009<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Ext.P3 judgment within a period of one month from<\/p>\n<p>the date of receipt of a copy of this judgment.<\/p>\n<p>3.   Learned       Senior     Government       Pleader<\/p>\n<p>Sri.P.   Nandakumar     appearing     for respondents<\/p>\n<p>submits that appeals against Ext.P3 are coming up<\/p>\n<p>before the Supreme Court on 15.5.2009.
