\tAll
\nthese petitions involve common questions on law and facts and
\ntherefore, they are disposed of by this common order.\n<\/p>\n
1.\tBy
\nway of these petitions under Article 226 of the Constitution of
\nIndia, the petitioner has prayed to quash and set aside the orders
\npassed by the Controlling Authority as also the Appellate Authority
\nunder The Payment of Gratuity Act, 1972 (for short,  the Act ),
\nwhereby, the petitioner has been directed to make payment towards
\nGratuity to the respondent-employees.\n<\/p>\n
2.\tThe
\npetitioner herein is an autonomous body functioning in the Office of
\nthe Industries Commissioner, Industries & Mines Department,
\nGovernment of Gujarat with 100% Grant-in-Aid and is engaged in the
\nactivity of providing services related to research & development,
\nextensions & training, assistance & guidance to small and
\nmedium scale industries within the State.\n<\/p>\n
3.\tThe
\nrespondents herein, who were employees of the petitioner-agency, had
\nfiled Applications in the prescribed form before respondent
\nno.2-Controlling Authority claiming Gratuity. The said Applications
\npreferred by the respondents came to be allowed. Against the said
\norders, the petitioner-agency approached the Appellate Authority
\nunder the said Act by way of filing Appeals. However, the said
\nAppeals also came to be rejected. Hence, these petitions.\n<\/p>\n
4.\tHeard
\nlearned counsel Ms. Shrusti Thula, appearing on behalf of Ms. Roma
\nFidelis & Mr. Nilesh Pandya for the petitioners and perused the
\ndocuments on record.\n<\/p>\n
5.\tThe
\nmain contention raised on behalf of the petitioner-agency is that it
\nis governed by its own Service Rules and that the employees concerned
\nare entitled for Gratuity, if they fulfill the requisite criteria, as
\nprovided under the said Service Rules.\n<\/p>\n
6.\tBefore
\nwe embark upon the merits of the case, it would be fruitful to refer
\nto certain provisions of the said Act, more particularly, Section
\n4(5) & Section 14. The said provisos are reproduced hereunder for
\nready reference;\n<\/p>\n
 4. Payment of
\ngratuity.- (5) Nothing in this section shall affect the right of
\nan employee to receive better terms of gratuity under any award or
\nagreement or contract with the employer.\n<\/p>\n
14. Act to override other
\nenactments, etc. – The provisions of this Act or any rule made
\nthereunder shall have effect notwithstanding anything inconsistent
\ntherewith contained in any enactment other than this Act or in any
\ninstrument or contract having effect by virtue of any enactment other
\nthan this Act.\n<\/p>\n
7.\tThe
\nabove two provisos conclusively demonstrate that the provisions of
\nThe Payment of Gratuity Act, 1972 override other enactments,
\netc. if such enactment\/s contains anything which is inconsistent with
\nthe provisions of the said Act. In the present case, the relevant
\nclauses of the Service Rules of the petitioner-agency, which deals
\nwith the issue of Gratuity, are inconsistent with the provisions of
\nthe said Act. Therefore, the provisions of the said Act will override
\nthe clauses relating to Gratuity, as framed in the Service Rules of
\nthe petitioner-agency. In view of the above, the authorities
\nconcerned were completely justified in passing the impugned orders
\nand hence, I find no reasons to interfere in these petitions.\n<\/p>\n
8.\tThe
\npetitioners (In S.C.A. No.5883\/2010) have claimed Interest on the
\namount of Gratuity, which are lying with the respondent-authorities.
\nIn my opinion, the petitioners are not entitled to receive any
\nInterest on the amount of Gratuity, which have been deposited before
\nthe respondent-authorities by the petitioner-agency, since there is
\nno provision regarding Interest under the said Act. In the absence of
\nany such proviso, this Court cannot issue directions for the grant of
\nInterest on the amount of Gratuity.\n<\/p>\n
9.\tConsequently,
\nall the petitions stand rejected. It is, however, observed that the
\npetitioners (In S.C.A. No.5883\/2010) shall be at liberty to file
\nappropriate proceedings before the competent Court for the purpose of
\nclaiming Interest. Notice is discharged.\n<\/p>\n
