Nos. 95, 98, 247, 260, 269,\n                           453, 670 and 1327 of 2009\n                   - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                 Dated this the 21st day of December, 2009.\n\n                                       JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J,<\/p>\n<p>            The point that arises for decision in these appeals is<\/p>\n<p>whether the Government can grant recognition to a school,<\/p>\n<p>which was remaining unrecognised, from day one of its<\/p>\n<p>establishment. A few writ petitions were filed before this<\/p>\n<p>Court    by     persons,           running             aided\/recognised            schools,<\/p>\n<p>challenging the decision of the Government and also the<\/p>\n<p>follow-up proceedings of the Director of Public Instruction, to<\/p>\n<p>grant recognition to certain unrecognised schools, which were<\/p>\n<p>functioning for the last few years in Malappuram and<\/p>\n<p>Kasaragod Districts.             Since the very same point arose for<\/p>\n<p>decision in all the writ petitions, the learned Single Judge heard<\/p>\n<p>and allowed them by a common judgment dated 20.10.2008.<\/p>\n<p>W.A.95\/2009 &amp; con. cases.         2<\/p>\n<p>Challenging the said judgment, the affected respondents have<\/p>\n<p>preferred these appeals. Therefore, they are heard and disposed of<\/p>\n<p>by this common judgment.\n<\/p>\n<p>W.A.247 of 2009.\n<\/p>\n<p>      2. This appeal is treated as the main case for the purpose of<\/p>\n<p>referring to the facts and documents. The fifth respondent in W.P.<\/p>\n<p>(C) 11126 of 2008 is the appellant. The first respondent herein<\/p>\n<p>was the writ petitioner. The first respondent is running an aided<\/p>\n<p>High School in Moonniyur in Malappuram District.                The<\/p>\n<p>appellant\/5th respondent was running an unrecognised English<\/p>\n<p>Medium High School within the vicinity of the first respondent&#8217;s<\/p>\n<p>School. The State Government issued Ext.P3 order dated<\/p>\n<p>13.6.2007, containing its policy on opening of new schools,<\/p>\n<p>upgrading     of     existing schools,  granting   recognition   to<\/p>\n<p>unrecognised schools, issuing NOC to CBSE\/ICSE Schools etc.<\/p>\n<p>While so, the Government issued Ext.P1 communication dated<\/p>\n<p>6.3.2008, asking the Director of Public Instruction (for short &#8220;DPI)<\/p>\n<p>W.A.95\/2009 &amp; con. cases.         3<\/p>\n<p>to arrange to publish a list of schools, mentioned in that<\/p>\n<p>communication as a preliminary notification for grant of<\/p>\n<p>recognition, in the Gazette, immediately. Serial No.9 in Ext.P1 is<\/p>\n<p>Nibras Secondary School, Moonniyur, Malappuram, run by the<\/p>\n<p>appellant.    Pursuant to that, the DPI       published Ext.R5(a)<\/p>\n<p>notification dated 28.3.2008 in the Kerala Gazette dated<\/p>\n<p>10.4.2008.     The list of schools appended to that notification<\/p>\n<p>included the appellant&#8217;s school, which was shown as Serial No.9.<\/p>\n<p>The said notification stated that the schools mentioned therein are<\/p>\n<p>proposed to be recognised.       Those who have objections were<\/p>\n<p>called upon to file their objections.\n<\/p>\n<p>      3. According to the first respondent, the steps taken under<\/p>\n<p>Exts.P1 and R5(a) were illegal and contrary to the provisions of<\/p>\n<p>Rule 2 and Rule 2A of Chapter V of the Kerala Education Rules<\/p>\n<p>( for short &#8220;KER&#8221;).       Further, the aforementioned actions run<\/p>\n<p>contrary to the law laid down in Ext.P2 judgment of the Apex<\/p>\n<p>Court and also against the provisions of Ext.P3 order. The policy<\/p>\n<p>W.A.95\/2009 &amp; con. cases.        4<\/p>\n<p>contained in Ext.P3 was, in fact, not to recognise unrecognised<\/p>\n<p>unaided schools. But, an exception to that policy was made in<\/p>\n<p>relation to areas, where members of the educationally backward<\/p>\n<p>Muslim      community     reside, in   Malappuram,       Kasaragod,<\/p>\n<p>Kozhikode, Kannur and Wayanad Districts, subject to certain<\/p>\n<p>conditions. The relevant portion of the said Government Order<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>      &#8220;2. Recognition of Unaided Schools and NOC for<\/p>\n<p>      CBSE\/ICSE Schools<\/p>\n<blockquote><p>      1. As a policy, un-aided unrecognised schools will not<\/p>\n<p>      be given recognition.<\/p><\/blockquote>\n<p>      2. In order to overcome the educational backwardness<\/p>\n<p>      of the Muslim Community, recognition will be granted<\/p>\n<p>      and NOC for starting CBSE\/ICSE schools shall be<\/p>\n<p>      issued to those unaided schools satisfying the following<\/p>\n<p>      conditions apart from those specified in the Kerala<\/p>\n<p>      Education Rules as the Government are convinced that<\/p>\n<p>      extreme educational backwardness among the members<\/p>\n<p>      of the Muslim Community persists in certain areas of<\/p>\n<p>      Malappuram, Kozhikode, Kasargod, Kannur, and<\/p>\n<p>W.A.95\/2009 &amp; con. cases.        5<\/p>\n<p>      Wayanad Districts. Accordingly applications will be<\/p>\n<p>      limited to the above districts alone. The Additional<\/p>\n<p>      conditions are the following:\n<\/p>\n<p>      a)   The school shall have started functioning on or<\/p>\n<p>      before 01.06.2000.\n<\/p>\n<p>      b) The School shall have a minimum of 500 students on<\/p>\n<p>      its roll.\n<\/p>\n<p>      c) The school shall have classes from 1 to 10.<\/p>\n<p>      d) The school shall be functioning in a socially and<\/p>\n<p>      educationally backward locality.&#8221;\n<\/p>\n<p>According to the first respondent, the policy contained in Ext.P3<\/p>\n<p>could be implemented only in accordance with the provisions of<\/p>\n<p>the Kerala Education Act and Rules. But, the action taken under<\/p>\n<p>Ext.P1 and Ext.R5(a) is clearly illegal. Raising these grounds, the<\/p>\n<p>writ petition was filed. The appellant\/fifth respondent, one of the<\/p>\n<p>contesting respondents, filed a detailed counter affidavit and an<\/p>\n<p>additional counter affidavit, resisting the prayers in the writ<\/p>\n<p>petition. The first respondent\/petitioner filed a reply affidavit. The<\/p>\n<p>learned Single Judge, after hearing both sides, allowed the writ<\/p>\n<p><span class=\"hidden_text\">W.A.95\/2009 &amp; con. cases.          6<\/span><\/p>\n<p>petition and quashed Ext.P1 order of the Government and Ext.R5<\/p>\n<p>(a) notification of the DPI. Feeling aggrieved by the said decision<\/p>\n<p>of the learned Single Judge, this appeal is preferred.<\/p>\n<p>            4. We heard Sri.P.K.Suresh Kumar, the learned counsel<\/p>\n<p>for the appellant, Sri.V.A. Mohammed, the learned counsel for the<\/p>\n<p>first respondent and the learned Government Pleader for<\/p>\n<p>respondents 7 to 15. We also heard the learned counsel M\/s. K.<\/p>\n<p>Jaju Babu and Elvin Peter, who appeared in the connected Writ<\/p>\n<p>Appeals.\n<\/p>\n<p>            5. The learned counsel for the appellant submitted that<\/p>\n<p>Rule 2A applies only to opening of new schools and does not<\/p>\n<p>cover recognition of existing schools. For that, according to the<\/p>\n<p>learned counsel, the relevant rule is Rule 17. It is submitted that<\/p>\n<p>the appellant satisfies all the conditions in Rule 17, except the one<\/p>\n<p>in sub-rule (i) thereof. When the Government decided to grant<\/p>\n<p>recognition to the appellant&#8217;s School, it should be taken that the<\/p>\n<p>Government had invoked its power under Rule 3 of Chapter I of<\/p>\n<p>W.A.95\/2009 &amp; con. cases.        7<\/p>\n<p>the KER.       If that be so, there is nothing illegal with the<\/p>\n<p>proceedings of the Government and the DPI. In support of the<\/p>\n<p>contention that the Government had invoked its power under Rule<\/p>\n<p>3 of Chapter I of the K.E.R., the learned counsel relied on the<\/p>\n<p>decision reported in <a href=\"\/doc\/191200\/\">Cannanore District Muslim Educational<\/p>\n<p>Association v. State of Kerala<\/a> (2008(2) KLT 879).           Special<\/p>\n<p>reference was made to paragraph 23, wherein the grant of new<\/p>\n<p>schools to Managers of Colleges on delinking of Pre-degree<\/p>\n<p>courses was sustained, relying on Rule 3 of Chapter I of the KER.<\/p>\n<p>            6. The learned counsel for the first respondent<\/p>\n<p>supported the views of the learned Single Judge. The learned<\/p>\n<p>Government Pleader submitted that the Government have accepted<\/p>\n<p>the judgment and issued consequential notification under Rule 2<\/p>\n<p>of Chapter V of the KER, proposing the places where the unaided<\/p>\n<p>schools are to be recognised. The notification dated 18.9.2009 is<\/p>\n<p>published in the Gazette dated 6.10.2009. Ward Nos. 11 and 19 of<\/p>\n<p>W.A.95\/2009 &amp; con. cases.         8<\/p>\n<p>Moonniyur Grama Panchayat are included as places proposed for<\/p>\n<p>recognition of unaided schools in Malappuram District.           The<\/p>\n<p>appellant&#8217;s school is functioning in that area.<\/p>\n<p>            7. Before dealing with the rival contentions, we will<\/p>\n<p>refer to the statutory provisions dealing with recognition of<\/p>\n<p>schools. Schools are generally classified into Government Schools<\/p>\n<p>and private schools. Private Schools are further classified into<\/p>\n<p>aided schools and recognised schools. Sub-section (7) of Section<\/p>\n<p>2 of the Kerala Education Act (for short, &#8220;the Act&#8221;) defines &#8216;private<\/p>\n<p>school&#8217;. As per the definition, &#8216;private school&#8217; means an aided or<\/p>\n<p>recognised school. &#8216;Aided School&#8217; is defined in Section 2(1) as a<\/p>\n<p>private school, which is recognised and is receiving aid from the<\/p>\n<p>Government. Under Rule 2(8) &#8216;recognised school&#8217; means a private<\/p>\n<p>school recognised by the Government under this Act. Section 3 of<\/p>\n<p>the Act deals with establishment and recognition of schools.<\/p>\n<p>Section 3 reads as follows:\n<\/p>\n<p>W.A.95\/2009 &amp; con. cases.        9<\/p>\n<p>     &#8220;3. Establishment and recognition of schools:-<\/p>\n<p>            (1) The Government may regulate the primary<\/p>\n<p>     and other stages of         education and courses of<\/p>\n<p>     instructions in Government and private schools.<\/p>\n<p>            (2) The Government shall take, from time to time,<\/p>\n<p>     such steps as they         may consider necessary or<\/p>\n<p>     expedient, for the purpose of providing facilities for<\/p>\n<p>     general education, special education and for the<\/p>\n<p>     training of teachers.\n<\/p>\n<p>            (3)    The Government may, for the purpose of<\/p>\n<p>     providing such facilities:-\n<\/p>\n<p>            (a) establish and maintain schools; or<\/p>\n<p>            (b)    permit any person or body of persons to<\/p>\n<p>     establish and maintain aided schools; or<\/p>\n<p>            (c)      recognise any school established and<\/p>\n<p>     maintained by any person or body of persons.<\/p>\n<p>            (4) All existing schools shall be deemed to have<\/p>\n<p>     been established in accordance with the Act:<\/p>\n<p>            Provided that the educational agency of an aided<\/p>\n<p>     school existing at the commencement of this section<\/p>\n<p>     may, at any time within one month of such<\/p>\n<p>W.A.95\/2009 &amp; con. cases.       10<\/p>\n<p>     commencement, after giving notice to the Government<\/p>\n<p>     of its intention so to do, opt to run the school as a<\/p>\n<p>     recognised school, subject to the condition that the<\/p>\n<p>     services of the teachers and other members of the staff<\/p>\n<p>     of the school shall not be dispensed with or their<\/p>\n<p>     conditions of service under the management varied to<\/p>\n<p>     their disadvantage on account of the exercise of this<\/p>\n<p>     option.\n<\/p>\n<p>            (5)    After the commencement of this Act, the<\/p>\n<p>     establishment of a new school or the opening of a<\/p>\n<p>     higher class in any private school shall be subject to<\/p>\n<p>     the provisions of this Act, and the rules made<\/p>\n<p>     thereunder and any school or higher class established<\/p>\n<p>     or opened otherwise than in accordance with such<\/p>\n<p>     provisions shall not be entitled to be recognised by the<\/p>\n<p>     Government.&#8221; (emphasis supplied)<\/p>\n<p>Sub-section (5) of Section 3 quoted above clearly shows that any<\/p>\n<p>school established or opened otherwise than in accordance with<\/p>\n<p>the provisions of the Act and the Rules made thereunder shall not<\/p>\n<p>W.A.95\/2009 &amp; con. cases.        11<\/p>\n<p>be entitled to be recognised by the Government. The relevant rules<\/p>\n<p>concerning opening and recognition of schools are contained in<\/p>\n<p>Chapter V of the KER. Sub-rule (5) of Rule 1 reads as follows:<\/p>\n<blockquote><p>     &#8220;1(5)     The opening of    schools by an Educational<\/p>\n<p>     Agency and their recognition shall be governed by the<\/p>\n<p>     procedure laid down in the rules below and they shall<\/p>\n<p>     apply mutatis mutandis to the opening and recognition<\/p>\n<p>     of new standards.       Permission to open and for<\/p>\n<p>     recognition for each standard shall be separately<\/p>\n<p>     obtained.&#8221;(emphasis supplied)<\/p>\n<p>The rules mentioned in the above quoted sub-rule are Rules 2 and<\/p>\n<p>2A. Rule 2(1) reads as follows:\n<\/p><\/blockquote>\n<blockquote><p>     &#8220;2.Procedure for determining the area where new<\/p>\n<p>     schools are to be opened or existing schools<\/p>\n<p>     ungraded-(1)The Director may, from time to time,<\/p>\n<p>     prepare two lists, one in respect of aided schools and<\/p>\n<p>     the other in respect of recognised schools, indicating<\/p>\n<p>     the localities where new schools of any or all grads are<\/p>\n<p>     to be opened and existing Lower Primary School or<\/p>\n<p>W.A.95\/2009 &amp; con. cases.         12<\/p>\n<p>     Upper Primary Schools or both are to be upgraded. In<\/p>\n<p>     preparing such lists he shall take into consideration the<\/p>\n<p>     following:\n<\/p><\/blockquote>\n<blockquote><p>            (a) the existing schools in and around the locality<\/p>\n<p>     in which new schools are to be opened or existing<\/p>\n<p>     schools are to be upgraded;\n<\/p><\/blockquote>\n<blockquote><p>            (b) the strength of the several standards and the<\/p>\n<p>     accommodation available in each of the existing<\/p>\n<p>     schools in that locality;\n<\/p><\/blockquote>\n<blockquote><p>            (c) The distance from each of the existing schools<\/p>\n<p>     to the area where new schools are proposed to be<\/p>\n<p>     opened or to the area where existing schools are to be<\/p>\n<p>     upgraded;\n<\/p><\/blockquote>\n<blockquote><p>            (d)    the educational needs of the locality with<\/p>\n<p>     reference to the habitation and backwardness of the<\/p>\n<p>     area; and<\/p>\n<\/blockquote>\n<blockquote><p>            (e) other matters which he considers relevant and<\/p>\n<p>     necessary in this connection.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>     Explanation:- for the removal of doubts it is hereby<\/p>\n<p>     clarified that it shall not be necessary to prepare the<\/p>\n<p>     two lists simultaneously and that it shall be open to the<\/p>\n<p>     Director to prepare only one of the lists.&#8221; (emphasis<\/p>\n<p>     supplied)<\/p>\n<p>W.A.95\/2009 &amp; con. cases.       13<\/p>\n<p>Sub-rule (2) of Rule 2 provides that the Director shall publish the<\/p>\n<p>list mentioned in sub-rule (1) in the official gazette, inviting<\/p>\n<p>objections.     The objections shall be enquired into by the<\/p>\n<p>educational officers and the enquiry reports will be submitted to<\/p>\n<p>the Director. The Director will consider them and send them to the<\/p>\n<p>Government along with his recommendations under sub-rule (3).<\/p>\n<\/blockquote>\n<p>Sub-rule (4) provides that the Government after scrutinizing all the<\/p>\n<p>records may approve the list, with or without modification and<\/p>\n<p>forward it to the Director, who, in turn, will publish the list so<\/p>\n<p>approved by the Government in the Gazette. Rule 2A deals with<\/p>\n<p>invitation of applications for opening of new schools and<\/p>\n<p>upgrading of existing Schools in the areas notified under Rule 2(4).<\/p>\n<p>The said rule reads as follows:\n<\/p>\n<blockquote><p>     &#8220;2A. Applications for opening of new schools and<\/p>\n<p>     upgrading of existing schools &#8211; (1)            After the<\/p>\n<p>     publication of the final list of the areas where new<\/p>\n<p>     schools of any or all grades are to be opened or<\/p>\n<p>     existing Lower Primary Schools or Upper Primary<\/p>\n<p>W.A.95\/2009 &amp; con. cases.        14<\/p>\n<p>     Schools or both are to be upgraded the Director shall,<\/p>\n<p>     by a notification in the Gazette call for applications for<\/p>\n<p>     the opening of New schools of any or all grades and for<\/p>\n<p>     raising of the grade of existing Lower Primary Schools<\/p>\n<p>     or Upper Primary Schools or both in the area<\/p>\n<p>     specified.\n<\/p><\/blockquote>\n<blockquote><p>            (2) Applications for opening of new schools or<\/p>\n<p>     for raising of grade of existing schools shall be<\/p>\n<p>     submitted only in response to the notification published<\/p>\n<p>     by the Director. Applications received otherwise shall<\/p>\n<p>     not be considered. The applications shall be submitted<\/p>\n<p>     to the District Educational Officer of the area<\/p>\n<p>     concerned in form No.1 with 4 copies of the application<\/p>\n<p>     and enclosures within one month from the date of<\/p>\n<p>     publication of the notification under sub-rule (1).<\/p><\/blockquote>\n<p>            (3) On receipt of the applications for permission<\/p>\n<p>     to open new schools or for upgrading of existing<\/p>\n<p>     schools, the District Educational Officer shall make<\/p>\n<p>     such enquiries as he may deem fit as to the correctness<\/p>\n<p>     of the statements made in the application and other<\/p>\n<p>     relevant matters regarding such applications and<\/p>\n<p>W.A.95\/2009 &amp; con. cases.       15<\/p>\n<p>     forward the applications with his report thereon to the<\/p>\n<p>     Director within one month from the last date for<\/p>\n<p>     submitting applications under sub-rule (2).<\/p>\n<p>            (4) The Director on receipt of the applications<\/p>\n<p>     with the report of the District Educational Officer shall<\/p>\n<p>     forward the applications with his report to Government<\/p>\n<p>     within one month from the last date for forwarding the<\/p>\n<p>     report by the District Educational Officer.<\/p>\n<p>            (5)    The    Government    shall   consider  the<\/p>\n<p>     applications in the light of the report of the District<\/p>\n<p>     Educational Officer and the Director and other<\/p>\n<p>     relevant matters which the Government think necessary<\/p>\n<p>     to be considered in this connection and shall take a<\/p>\n<p>     final decision and publish their decision in the Gazette<\/p>\n<p>     with the list containing necessary particulars within<\/p>\n<p>     one month from the last date for forwarding the report<\/p>\n<p>     by the Director.\n<\/p>\n<p>            (6) Applications for permission to open a new<\/p>\n<p>     standard in an existing school during any school year<\/p>\n<p>     not involving the raising of the grade of the school<\/p>\n<p>     shall be submitted to the District Educational Officer in<\/p>\n<p>     charge of the area in form 1 in triplicate.\n<\/p>\n<p>            (7) x x x<\/p>\n<p><span class=\"hidden_text\">W.A.95\/2009 &amp; con. cases.          16<\/span><\/p>\n<p>            (8) The Government may, by notification in the<\/p>\n<p>     Gazette, extend any period specified in sub-rules (3),<\/p>\n<p>     (4) and (5) for reasons to be stated in the notification.&#8221;<\/p>\n<p>            8. Sub-rule (1) of Rule 2 specifically mentions about<\/p>\n<p>two lists, one in respect of aided schools and the other in respect of<\/p>\n<p>recognised schools.        Rule 2A does not mention about any<\/p>\n<p>particular list, but it governs both the lists mentioned in sub rule (1)<\/p>\n<p>of Rule 2. Therefore, recognition of a school as an unaided school<\/p>\n<p>can be granted only in a place identified under Rule 2, in respect of<\/p>\n<p>which applications were invited under Rule 2A.                Without<\/p>\n<p>following the procedure provided under Rules 2 and 2A, we think,<\/p>\n<p>no school can be recognised. But, the learned counsel for the<\/p>\n<p>appellant relied on Rule 17 of the Rules, which deals with the<\/p>\n<p>recognition of existing schools. But, sub-rule (1) of Rule 17 says<\/p>\n<p>that a school opened with the permission under Rule 11 alone can<\/p>\n<p>be granted recognition. Rule 11 deals with the grant of permission<\/p>\n<p>to open schools included in the development plan approved by the<\/p>\n<p>Government. Development plan mentioned in that rule is the plan<\/p>\n<p><span class=\"hidden_text\">W.A.95\/2009 &amp; con. cases.          17<\/span><\/p>\n<p>prepared by the District Planning Committee and approved by the<\/p>\n<p>Government, while preparing the State plan. In this context, it is<\/p>\n<p>fruitful to refer Section 17 of the Act. Sub section (1) of Section<\/p>\n<p>17 reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>      &#8220;17.Establishment of District Educational Authority-<\/p>\n<p>      (1) For the purpose of associating people with the<\/p>\n<p>      administration of education and to preserve and<\/p>\n<p>      stimulate local interest in education affairs, each<\/p>\n<p>      District Planning Committee constituted under Section<\/p>\n<p>      53 of the Kerala Municipality Act, 1994 (20 of 1994),<\/p>\n<p>      shall establish a District Educational Authority having<\/p>\n<p>      jurisdiction in the district.&#8221;\n<\/p><\/blockquote>\n<p>For the purpose of associating people with the administration of<\/p>\n<p>education and to preserve and stimulate local interest in<\/p>\n<p>educational affairs, each District Planning Committee constituted<\/p>\n<p>under Section 53 of the Kerala Municipality Act, 1994, shall<\/p>\n<p>establish a District Educational Authority having jurisdiction in<\/p>\n<p>the District. Section 18 deals with the functions of the District<\/p>\n<p>W.A.95\/2009 &amp; con. cases.      18<\/p>\n<p>Educational Authority, which includes opening of new schools or<\/p>\n<p>upgrading of existing schools.    Section 18A deals with the<\/p>\n<p>formation of Educational Development Committee for each school<\/p>\n<p>by the local authority concerned.     Sections 17 to 18A were<\/p>\n<p>introduced by way of an amendment on 12.5.2000, as part of<\/p>\n<p>entrusting the management of Government schools to the District<\/p>\n<p>Panchayats and Grama Panchayats. Section 5A was introduced on<\/p>\n<p>12.5.2000, which deals with handing over the management of<\/p>\n<p>Government Schools and that of aided Schools taken over by the<\/p>\n<p>Government to the Local Authorities. Section 53 of the Kerala<\/p>\n<p>Municipality Act deals with the formation of a District Planning<\/p>\n<p>Committee for each district by the Government, consisting of the<\/p>\n<p>members specified in sub-section (2) thereof. Sub-section (10)<\/p>\n<p>thereof provides that the Committee shall prepare a draft<\/p>\n<p>development plan of Panchayats and Municipalities in the District,<\/p>\n<p>which, if approved by the Government, will be included in the<\/p>\n<p>State plan. Rule 11 of Chapter V of the K.E.R. refers to the power<\/p>\n<p>W.A.95\/2009 &amp; con. cases.       19<\/p>\n<p>of the Government to open schools included in the development<\/p>\n<p>plan. The said plan is the plan prepared by the District Planning<\/p>\n<p>Committee with the junction of the          Educational Authority<\/p>\n<p>concerned. That is clear from Notes (i) and (ii) of Rule 11, which<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>     &#8220;Note (i) A copy of the order shall be furnished to the<\/p>\n<p>     Local Educational Authority (if any).<\/p>\n<\/blockquote>\n<blockquote><p>     (ii)   No school which has not been included in the<\/p>\n<p>     development plan of the Educational Authority, if any,<\/p>\n<p>     shall be opened.&#8221;\n<\/p><\/blockquote>\n<p>Note (ii) quoted above, specifically says that no school, which has<\/p>\n<p>not been included in the development plan of the Educational<\/p>\n<p>Authority shall be opened. So, the power of the Government to<\/p>\n<p>open new schools is subject to the condition of their inclusion in<\/p>\n<p>the development plan of the Educational Authority. Recognition<\/p>\n<p>under Rule 17 contemplates a school opened under Rule 11.<\/p>\n<p>Therefore, the reliance placed by the learned counsel on Rule 17,<\/p>\n<p>to support the impugned action of the Government and the<\/p>\n<p>W.A.95\/2009 &amp; con. cases.         20<\/p>\n<p>Director, is plainly untenable.     Further, since the appellant does<\/p>\n<p>not have a case that the school was established under Rule 11,<\/p>\n<p>there is no question of application of Rule 17.<\/p>\n<p>            9.     Since we have already found that even for<\/p>\n<p>recognising a school, the procedures prescribed under Rules 2 and<\/p>\n<p>2A of Chapter V of the K.E.R., have to be followed, the<\/p>\n<p>unauthorised and illegal functioning of a school for sometime will<\/p>\n<p>not confer any right on the appellant to seek recognition or<\/p>\n<p>empower the Government to grant recognition de hors the<\/p>\n<p>provisions of Rule 2 and Rule 2A of Chapter V of the K.E.R. It is<\/p>\n<p>so declared.     The decision    in   Cannanore District Muslim<\/p>\n<p>Educational Association&#8217;s Case (Supra) has no application to the<\/p>\n<p>facts of this case. The provisions of Rule 3 of Chapter I of the<\/p>\n<p>K.E.R. cannot be invoked for sustaining the impugned orders in<\/p>\n<p>view of S.3(5) of the Act.\n<\/p>\n<p>            10. In the result, we find no reason to interfere with the<\/p>\n<p>judgment under appeal and therefore the writ appeal is dismissed.<\/p>\n<pre>W.A.95\/2009 &amp; con. cases.      21\n\n\n\nW.A. Nos. 95, 98, 260, 269,\n453, 670 and 1327 of 2009\n\n<\/pre>\n<p>            In view of the dismissal of W.A. 247 of 2009, these<\/p>\n<p>appeals are also dismissed.\n<\/p>\n<\/p>\n<p>                                       K.
