It is submitted that the respondent-School is run by the<br \/>\n\tTripada Education Trust.  It is further the case of the petitioner<br \/>\n\tthat in pursuance of the above referred appointment order, he has<br \/>\n\tbeen discharging his duties with effect from 11th June<br \/>\n\t2007 with the respondent-School. It is submitted that he has<br \/>\n\treceived his salary upto September, 2007. However, from October,<br \/>\n\t2007 his salaries were withheld by the respondent-School Management.<br \/>\n\tThe petitioner had also apprehended his termination from the<br \/>\n\trespondent-School.\n<\/p>\n<p>On<br \/>\n\taccount of the said apprehension, the petitioner preferred<br \/>\n\tApplication No.7 of 2008 before the Gujarat Secondary Education<br \/>\n\tTribunal at Ahmedabad. However, taking into consideration the pros<br \/>\n\tand cons of the matter as well as the reply affidavits filed by the<br \/>\n\trespondents herein, the Tribunal rejected the application made by<br \/>\n\tthe petitioner on the ground of jurisdiction. Hence, this petition.\n<\/p>\n<p>Having<br \/>\n\theard the contentions raised by the petitioner-Party-In-Person,<br \/>\n\tperusing the averments made in the application as well as the<br \/>\n\tdocuments on record and the impugned order, it transpires that the<br \/>\n\tTripada International School which is run by the Tripada Education<br \/>\n\tTrust is not registered as a secondary school with the Gujarat<br \/>\n\tSecondary Education Board as required under Section 31 of the<br \/>\n\tGujarat Secondary and Higher Secondary Education Act, 1972<br \/>\n\t(hereinafter referred to as  the Act ). Thus, when the grievance<br \/>\n\tof the petitioner does not fall under the category of grievance<br \/>\n\tbetween the Manager of a registered private secondary school and a<br \/>\n\tperson in service of such school as stipulated under Section 38(1)<br \/>\n\tof the Act. Therefore, the Tribunal has rightly held that the<br \/>\n\tTribunal has no jurisdiction to entertain such an application. I am<br \/>\n\tin complete agreement with the reasons assigned by the Tribunal and<br \/>\n\tI adopt the same since there is no illegality or infirmity in the<br \/>\n\tsaid decision. Therefore, I do not find any merit in the present<br \/>\n\tpetition and the present petition is nothing but a misconceived<br \/>\n\tpetition. Hence, the present petition deserves to be dismissed.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, the present petition fails and is, accordingly,<br \/>\n\tdismissed in limine.\n<\/p>\n<p>It<br \/>\n\tis, however, made clear that if there is any breach of Section 52 of<br \/>\n\tthe Act and if an application is moved to the appropriate authority,<br \/>\n\tthe respondent-authority will take appropriate action against the<br \/>\n\trespondent-School Management for running school without prior<br \/>\n\tregistration under the concerned Act.
