The State has also filed Criminal Appeal<br \/>\nNo. 425 of 1996 against the said judgement challenging acquittal of<br \/>\noriginal accused Nos. 3, 4, 5 and 6.\n<\/p>\n<p>2.\t\tThe<br \/>\nlearned Additional Sessions Judge convicted the appellants of<br \/>\nCriminal Appeal No.226 of 1996 for offence punishable under Section<br \/>\n302 of Indian Penal Code and sentenced them to R.I. for life and<br \/>\nimposed fine of Rs.10,000\/- and, in default, to suffer S.I.  for six<br \/>\nmonths. The Trial Court also convicted the appellant Nos. 1 and 2 for<br \/>\noffence punishable under Section 323 of IPC and sentenced them for<br \/>\nS.I. for one month and to pay fine of Rs.100\/-, and, in default<br \/>\nthereof, to undergo  S.I. for  7 days. The appellants No.1 and 2 also<br \/>\nwere convicted  for offence punishable under Section 135 of Bombay<br \/>\nPolice Act and were ordered to suffer imprisonment  for one month and<br \/>\nto pay fine of Rs.500\/-, and, in default thereof, to undergo S.I. for<br \/>\n7 days.\n<\/p>\n<p>3.\t\tThe<br \/>\nappellants were initially arrested on 1.3.1993 and have been in jail<br \/>\nthroughout during pendency of trial.\n<\/p>\n<p>4.\t\tThe<br \/>\ncase of the prosecution in brief  is that on 28.02.1993, at 8 O&#8217;clock<br \/>\nor thereabout, the accused No.1 and complainant Jiten Dineshbhai<br \/>\nBansali had a quarrel which resulted into accused NO.1 slapping<br \/>\ncomplainant Jiten, i.e. son of the deceased Dinesh Bansali. As a<br \/>\nresult thereof, the deceased Dineshbhai Bansali, complainant  Jiten<br \/>\nand some friends of Jiten went to meet accused No.1 for the purpose<br \/>\nof settlement at around 9.30, at the house of  accused No.3, who is<br \/>\nfather of accused No.1. It is further the prosecution case that at<br \/>\nthat time, accused No.1 and 2 gave blows  with knife to the deceased<br \/>\nand accused No.3 Ghumansinh caught hold of the deceased whereas<br \/>\nMohabatsinh caused injury to  witness Jiten, and Vipul Soni, original<br \/>\naccused No.6, was instigating the other accused.\n<\/p>\n<p>5.\t\tThe<br \/>\nprosecution examined various witnesses in support of its case. Dr.<br \/>\nNilesh Galaiya, PW 3, Exh.31  is the Doctor who was the Medical<br \/>\nOfficer at Irwin Group of Hospitals in the casualty OPD  on the date<br \/>\nof the incident and had the occasion to examine the deceased when he<br \/>\nwas first  brought to the hospital&#8217;s  casualty ward. He  deposed that<br \/>\non examination of the deceased Dinesh Bachubhai  he found two<br \/>\ninjuries on the person- one on the left hand side of the chest  which<br \/>\nwas an incise wound of 1 cm x 1 cm, with a cavity,  and  the second<br \/>\nwas a  incise wound  on the elbow to the left hand which was of 1 cm<br \/>\nx 1 cm. Having been given some treatment, the deceased died while  in<br \/>\nthe casualty OPD.  Dr. Satish Kalele, PW 3, Exh.25,  is the Doctor<br \/>\nwho performed postmortem  of the deceased. He has deposed that in<br \/>\nall, there were  nine external injuries  which were  cumulatively<br \/>\nsufficient to cause death.  The witness further deposed that injury<br \/>\nNo.1 was individually  also  sufficient to cause death.\n<\/p>\n<p>6.\t\tProsecution<br \/>\nalso examined complainant Jiten Dineshbhai, who is PW 3 Exh.2, who,<br \/>\nalong with witness Kirti Chottubhai Charola, PW 5, Exh.35,  supported<br \/>\nthe prosecution case.\n<\/p>\n<p>7.\t\tThe<br \/>\nTrial Court, after appreciation of evidence led by the prosecution,<br \/>\ncame to the conclusion that appellants- original accused Nos. 1 and 2<br \/>\nwere guilty for commission of offence punishable under Section 302 of<br \/>\nIPC  as well as Section 323 of IPC  read with Section 135 of Bombay<br \/>\nPolice Act and sentenced them to suffer R.I. for life. The Trial<br \/>\nCourt acquitted rest of the accused for want of evidence.\n<\/p>\n<p>8.\t\tIt<br \/>\nis in this background that the aforesaid two appeals, one by the<br \/>\nconvicted appellant Nos. 1 and 2 (original accused Nos.1 and 2) and<br \/>\nthe other by the State  against  acquittal of rest of the accused<br \/>\n(original accused Nos. 3,4,5 and 6) have been filed.\n<\/p>\n<p>9.<br \/>\nLearned counsel for the appellants urged that it is a case where<br \/>\nappellant No. 2 Ravirajsinh Gumansinh Jadeja has an injury in his<br \/>\nleg. The persons are  aged 19 and 20 years. Fight was sudden.<br \/>\nTherefore, it cannot be said that the offence as alleged by the<br \/>\nprosecution and held proved by the trial Court is correct position of<br \/>\nlaw. Learned counsel for the appellant further urged that the<br \/>\ninterested witness testimony was the only testimony available on<br \/>\nrecord and there was something which was talked about in between the<br \/>\nparties about the compromise.  The incident took on the spur of the<br \/>\nmoment. Hence the offence as alleged is not made out.\n<\/p>\n<p>10.\t\tPer<br \/>\ncontra ?  learned A.P.P. submitted that the case has been made out<br \/>\nby the prosecution. There was sufficient evidence available on<br \/>\nrecord. There was severe knife blow given by the accused on the<br \/>\ndeceased and multiple injuries are available. Both accused persons,<br \/>\nnamely accused Nos. 1 and 2 had caused knife injuries on vulnerable<br \/>\npart that this related to death and therefore the findings of the<br \/>\ntrial Court cannot be faulted. As regards narration of accused Nos. 1<br \/>\nand 2 is concerned, learned A.P.P. further urged that there is an<br \/>\nappeal challenging the acquittal of accused Nos. 3, 4, 5 and 6 and<br \/>\ntheir acquittal cannot be said to be one which is in accordance with<br \/>\nevidence and therefore their acquittal be set aside.  Arguing the<br \/>\nappeal, learned counsel submitted that the assault on the deceased<br \/>\nwas made by accused appellant Nos. 1 and 2.  Therefore, it cannot be<br \/>\nsaid that there was cumulative interest with the accused. In that<br \/>\nbackground the finding of the trial Court cannot be faulted with.<br \/>\nLearned counsel further submitted that cumulative intention is not<br \/>\nseen because the acquitted accused did not cause any injury to the<br \/>\ndeceased. In that view of the matter, the finding of the trial Court<br \/>\nacquitting accused Nos. 3 to 6 cannot be said to be perverse.\n<\/p>\n<p>11.\t\tWe<br \/>\nhave considered the rival submissions and we are of the considered<br \/>\nopinion that as regards accused Nos. 3,4,5 and 6, the appeal filed by<br \/>\nthe State against their acquittal deserves no consideration because<br \/>\nthe finding recorded by the trial Court cannot in any way be said to<br \/>\nbe perverse. In that background, no exception can be made of the<br \/>\nfindings recorded by the trial Court. Therefore, the State appeal<br \/>\ndeserves dismissal.\n<\/p>\n<p> 12.\t\tAs<br \/>\nregards accused ?  appellant Nos. 1 and 2, there is overwhelming<br \/>\nevidence against them that they have given severe knife blows on the<br \/>\ndeceased. There is no material on record to give their case for<br \/>\nlesser offence.  They have used their power and knowledge to cause<br \/>\ninjuries without any reason. They have been held to be guilty of<br \/>\noffence under Section 302 of the IPC and we do not see any reason to<br \/>\ntake a different view. If they were of the younger age that cannot be<br \/>\nsaid to be given licence to commit heinous crime. They were not<br \/>\njuvenile. In that background, the conviction as recorded by the trial<br \/>\nCourt is not found to be suffering from any infirmity. Their<br \/>\nconviction and sentence are confirmed.\n<\/p>\n<p>13.\t\tIn<br \/>\nthe result, the appeal filed by appellant-accused Nos. 1 and 2<br \/>\n is dismissed. The findings as recorded by the trial Court are not<br \/>\nfound to be suffering from any infirmity. The conviction and sentence<br \/>\nof accused Nos. 1 and 2 is confirmed. They are to serve out their<br \/>\nsentence.\n<\/p>\n<p>14.\t\tAppeal<br \/>\nNo. 425 of 1996 filed by the State against acquittal of original<br \/>\naccused Nos. 3, 4, 5 and 6 is dismissed.<\/p>\n<pre>\n \n\n\n \n\n\n \n\n\n\t(BHAGWATI\nPRASAD, J)        \t(BANKIM N.
