(J)\n\nCITATION:\n 1987 AIR  820\t\t  1987 SCR  (2)\t 47\n 1987 SCC  (1) 532\t  JT 1987 (2)\t 72\n 1987 SCALE  (1)141\n\n\nACT:\n    Constitution  of India, Articles 14 and  32:  Air-Condi-\ntioned\tCoach Incharges--Attendants, Northern  Railway--Dis-\ncriminated  against in payment of  overtime  allowance--Held\nnot justified.\n\n\n\nHEADNOTE:\n    The\t petitioners, Air-Conditioned  Coach  Incharges--At-\ntendants in Northern Railway, contended in their writ  peti-\ntions that their counterparts in Western, Central and  East-\nern  Railways were being paid overtime allowance  for  extra\nduty  hours  exceeding 96 hours in two weeks, and  sought  a\ndirection  to the Union of India and Railway  Administration\nto pay them the same allowance.\nAllowing the writ petition, the Court,\n    HELD: There\t was  no justification\tfor  denying   over-\ntime  allowance to the petitioners working in  the  Northern\nRailway.  The Union of India and the Railway  Administration\nto  pay with effect from June 1, 1984 overtime allowance  to\nthe  petitioners on the same basis on which  their  counter-\nparts in the other three Railways are paid. [48B-C]\n    The\t benefit  of the order to be extended  to  all\tsuch\nemployees  including  those who have retired and  those\t who\nhave not joined as petitioners. [48D]\n    All\t arrears  of such allowances up to date to  be\tpaid\nwithin four months. [48D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    ORIGINAL JURISDICTION:&#8217; Writ Petition (C) Nos.  13748-84<br \/>\nof 1984.\n<\/p>\n<p>With<br \/>\nWrit Petition (c) Nos. 1580626 of 1984.<br \/>\n(Under Article 32 of the Constitution of India. )<br \/>\n<span class=\"hidden_text\">48<\/span><br \/>\nN.N. Keshwani and R.N. Keshwani for the Petitioners.<br \/>\n    O.P. Sharma, Girish Chandra, C.V. Subba Rao and Miss  S.<br \/>\nRelan for the Respondents.\n<\/p>\n<p>The following Order of Court was delivered:\n<\/p>\n<p>    It\tis not disputed that the Air-conditioned  Coach\t In-<br \/>\nchargesAttendants  are\tbeing paid overtime  allowances\t for<br \/>\nextra  duty  hours exceeding 96 hours in two  weeks  in\t the<br \/>\nWestern Railway, Central Railway and Eastern Railway.  There<br \/>\nis  no justification for denying overtime allowances on\t the<br \/>\nsame basis to the Air-conditioned Coach Incharges-Attendants<br \/>\nin the Northern Railway. We accordingly direct the Union  of<br \/>\nIndia and the Railway Administration to pay with effect from<br \/>\nJuly  1, 1984 the overtime allowance to the  Air-conditioned<br \/>\nCoach  Incharges-Attendants working in the Northern  Railway<br \/>\non  the\t same basis on which the Air-conditioned  Coach\t In-<br \/>\ncharges-Attendants in the other three Railways, referred  to<br \/>\nabove,\tare paid. All arrears of such allowances  upto\tdate<br \/>\nshall  be  paid as early as possible and in  any  event\t not<br \/>\nlater than four months from today. The benefit of this order<br \/>\nshall be extended to all such employees including those\t who<br \/>\nhave  retired and those who have not joined  as\t petitioners<br \/>\nherein.\n<\/p>\n<p>The Writ Petitions are allowed.
