JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThese<br \/>\nthree Appeals preferred under clause 15 of the Letters Patent arise<br \/>\nfrom the judgment and order dated 12th February, 2008 and<br \/>\n29th February, 2008 passed by the learned Single Judge in<br \/>\nabove writ petitions.\n<\/p>\n<p>\tThe<br \/>\ncommon question that arises is, whether the writ petitioners who had<br \/>\nsought inter district transfer are entitled to higher pay scale on<br \/>\ncompletion of nine years&#8217; service including the services rendered in<br \/>\nthe parent district. The matter is no more res integra. The<br \/>\nquestion has been decided by this Court time and again. No case for<br \/>\ninterference is made out.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Munshaw has, however, appeared for the appellants and relied upon the<br \/>\nGovernment Resolution dated 15th July, 2004. He has<br \/>\nsubmitted that in view of the aforesaid Government Resolution dated<br \/>\n15th July, 2004, those who have sought inter-district<br \/>\ntransfer, are not entitled to higher pay scale on the basis of total<br \/>\nservices rendered in both the districts. We are unable to agree with<br \/>\nMr. Munshaw. The resolution speaks of repatriation of such employees<br \/>\nto their parent district. Further, the Government Resolution has not<br \/>\nbeen made retrospective. It<br \/>\nwould only mean that those employees who seek inter district transfer<br \/>\nafter 15th July, 2004, are not entitled to count<br \/>\ntheir earlier service for the purpose of higher pay scale. But, in<br \/>\ncase of transfers which were already made prior to 15th<br \/>\nJuly, 2004, such condition cannot now be introduced. For such cases,<br \/>\nthe Government Resolution provides for re-transfer to the parent<br \/>\ndistrict.  In case of the<br \/>\npresent respondents, the concerned authority may repatriate them to<br \/>\nthe parent district. However, they cannot be denied the benefit of<br \/>\nhigher pay scale on the basis of their total service.\n<\/p>\n<p>\tIn<br \/>\nabove view of the matter, the Appeals are dismissed.
