No. 4 of 2009 of Kasaragode Excise Range for<br \/>\nan offence punishable under Sec. 8(1) and (2) of the Abkari Act<br \/>\nfor allegedly having been found in possession of 5 litres of arrack<br \/>\nseeks anticipatory Bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.\n<\/p>\n<p>      3.    Anticipatory bail cannot be granted in a case involving<br \/>\nsuch grave offence.       It is too early to accept the petitioner&#8217;s<br \/>\ncontention that the petitioner has been falsely implicated.        There is<br \/>\nno reason why the petitioner should not surrender before the<br \/>\nmagistrate concerned and seek regular bail.              Accordingly, If the<br \/>\npetitioner surrenders before the Magistrate concerned within two<br \/>\nweeks from today and files an application for regular bail, the same<br \/>\nshall be considered and disposed of preferably on the same day on<br \/>\nwhich it is filed bearing in mind the decision in <a href=\"\/doc\/1158859\/\">Sukumari         v.
