JUSTICE GOPAL KRISHAN VYAS<\/p>\n<p>Mr. Mukesh Vyas, for the petitioner.\n<\/p>\n<p>Mr. Rameshwar Dave, for the respondents.<\/p>\n<p>             Heard learned counsel for the parties.<\/p>\n<p>             In    this       case,    the          petitioner      is    claiming<\/p>\n<p>selection     scale       which       is       prescribed      by    the     State<\/p>\n<p>Government        for     the     Work          Charge     employees        after<\/p>\n<p>completion of 9, 18 and 27 years of service.<\/p>\n<p>             The case of the petitioner is that he was<\/p>\n<p>declared     semi      permanent       on       the     post   of    Mate    after<\/p>\n<p>completion        of    two     years          of    service     although     the<\/p>\n<p>petitioner has not submitted any documentary evidence<\/p>\n<p>but   the     respondents         have          filed     certain        documents<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>including     certified        copy       of     service    book     of    the<\/p>\n<p>petitioner.       In the Service Book, the first entry of<\/p>\n<p>appointment has been shown as \u0936\u0915\u0930\u0932 \u0932 \u092e\u091f, in the second<\/p>\n<p>column, it is shown as &#8220;\u0938 \u092f &#8221; and in seventh column,<\/p>\n<p>the date of appointment is shown as 1.1.1956.                        Meaning<\/p>\n<p>thereby,     as   per    documentary            evidence    filed    by     the<\/p>\n<p>respondents, the petitioner was initially appointed as<\/p>\n<p>Mate   on    1.1.1956,        which        is    admittedly        prior    to<\/p>\n<p>promulgation      of    the   Work        Charge    Rules,       1964.     The<\/p>\n<p>petitioner was further promoted on the post of Mistri<\/p>\n<p>as   per    channel     of    promotion         provided     in    the     Work<\/p>\n<p>Charge Rules vide order dated 17.11.1978 as evident<\/p>\n<p>from the service book of the petitioner.                             Meaning<\/p>\n<p>thereby,     in    whole       of     the        service     tenure,        the<\/p>\n<p>petitioner was provided one promotion on the post of<\/p>\n<p>Mistri.      Therefore, according to the Circular dated<\/p>\n<p>4.3.1998 issued by the Government for granting three<\/p>\n<p>promotional benefits after completion of 9, 18 and 27<\/p>\n<p>years of service was to be given to the petitioner but<\/p>\n<p>in whole of his service tenure only one promotion and<\/p>\n<p>one selection scale was given to the petitioner vide<\/p>\n<p>order dated 17.11.1978 and dated 21.7.2001 (Annexure-<\/p>\n<p>2) respectively.             In this view of the matter, the<\/p>\n<p>petitioner is entitled to be considered for grant of<\/p>\n<p>selection scale as per Circular dated 4.3.1998 by the<\/p>\n<p>Government for granting three selection scales after<\/p>\n<p>completion of 9, 18 and 27 years of service to the<\/p>\n<p>work   charge     employee.           Admittedly,          the    denial     of<br \/>\n<span class=\"hidden_text\">                                           3<\/span><\/p>\n<p>second selection scale to the petitioner is totally<\/p>\n<p>unfounded,         therefore,        respondents            are   directed     to<\/p>\n<p>calculate the service period of the petitioner w.e.f.<\/p>\n<p>1.1.1956      on    the    post      of       Mate    and    thereafter,      re-<\/p>\n<p>consider the matter of grant of selection scale to the<\/p>\n<p>petitioner and while doing so, the fact of promotion<\/p>\n<p>on the post of Mistri may be taken into account.<\/p>\n<p>              Learned Dy. Govt. Counsel submitted that the<\/p>\n<p>petitioner          was    initially            appointed         as    Beldar.<\/p>\n<p>Thereafter, he was promoted on the post of Mate in the<\/p>\n<p>year 1963 and as per Work Charge Rules, 1964, the post<\/p>\n<p>of Mate may be filled in 100% by promotion only.<\/p>\n<p>              In my opinion, the statement made by learned<\/p>\n<p>Dy.   Govt.     Counsel        is    totally         baseless     because     Work<\/p>\n<p>Charge Rules were made applicable in the year 1964<\/p>\n<p>whereas    as      per    service      book      of    the    petitioner      his<\/p>\n<p>initially appointment has been shown w.e.f. 1.1.1956<\/p>\n<p>on the post of Mate when Work Charge Rules were not in<\/p>\n<p>existence.\n<\/p>\n<\/p>\n<p>              In this view of the matter, the petitioner is<\/p>\n<p>entitled      for    three     selection         scale       as   per   Circular<\/p>\n<p>dated   4.3.1998,         if    no    promotion         is   granted     in   the<\/p>\n<p>service.        Admittedly, the petitioner was granted one<\/p>\n<p>promotion in the year 1978 on the post of Mistri and<\/p>\n<p>third selection scale on 21.7.2001 after completion of<\/p>\n<p>27 years of service.                  Therefore, the petitioner is<br \/>\n<span class=\"hidden_text\">                                                4<\/span><\/p>\n<p>       still entitled for second selection scale as per the<\/p>\n<p>       notification         issued        by       the     State     Government.<\/p>\n<p>       Accordingly,         the      respondents           are     directed      to<\/p>\n<p>       reconsider     and     to     pass      fresh      order    for   granting<\/p>\n<p>       benefit of selection scale as per Circular issued by<\/p>\n<p>       the Government for granting selection scale in lieu of<\/p>\n<p>       promotion while taking into account first appointment<\/p>\n<p>       on   the   post      of     Mate     w.e.f.        1.1.1956   and      first<\/p>\n<p>       promotion on the post of Mistri on 17.11.1978.                           The<\/p>\n<p>       respondents are directed to grant all consequential<\/p>\n<p>       benefits including arrears and revised pension within<\/p>\n<p>       a period of three months from the date of receipt of<\/p>\n<p>       certified copy of this order.
