SAGHIR AHMAD\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t  W I T H<br \/>\n\t     CIVIL APPEAL NOS. 451-455 OF 1997<br \/>\n (Arising out of SLP (C) Nos. 17404, 20099, 20100-20100A\/93<br \/>\n\t\t\tand 8998\/96)<br \/>\n\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We heard learned counsel for the parties.<br \/>\n     Admittedly, the  respondents came to be appointed on ad<br \/>\nhoc basis  pursuant to\twrit petition  fild earlier  by many<br \/>\nothers. The  High Court\t by its\t judgment dated\t 4.2.1991 in<br \/>\nWrit Petition No 295337\/90 had allowed the writ petition and<br \/>\nset  aside  the\t order\tof  the\t retrenchment  and  directed<br \/>\nregularisation of  their services.  Some of the respondents,<br \/>\nadmittedly, are\t senior to  those who had the benefit of the<br \/>\norder of regularisation as confirmed by this Court as on May<br \/>\n10, 1991.  Consequently, following the earlier judgment, the<br \/>\nHigh Court  in the impugned order allowed the writ petitions<br \/>\nwith similar  directions. Thus,\t these\tappeals\t by  special<br \/>\nleave have been filed.\n<\/p>\n<p>     In view  of the  fact that\t the earlier  orders of this<br \/>\nCourt have  become final,  the respondent  are\tentitled  to<br \/>\nregularisation of  their services.  The learned\t counsel for<br \/>\nthe  appellants\t  has  brought\tof  our\t notice\t that  since<br \/>\nsubsequently there was a development after the orders passed<br \/>\nby this\t Court, namely, some of the establishments have been<br \/>\nhanded to  the private\tsector and  some of  them are in the<br \/>\nprocess of  being wound up, the orders passed earlier by the<br \/>\nHigh Court  as confirmed by this Court and the present order<br \/>\nwould cause hardship to the appellant-Corporation. We do not<br \/>\nthink that  we\tcan  go\t into  that  aspect  of\t the  matter<br \/>\nparticularly, when  the order  in  favour  of  some  of\t the<br \/>\nemployees has  attained finality. Similarly, the respondents<br \/>\nare entitled to the some benefit.\n<\/p>\n<p>     However, if  there is any difficulty in working out, it<br \/>\nwill be\t open to  the Corporation  to convene  a tri partite<br \/>\nmeeting consisting  of workers&#8217;,  Union, One of the officers<br \/>\nof Labour  Department  and  an\tofficer\t of  the  appellant-<br \/>\nCorporation would  thrash out  the problems and arrive at an<br \/>\namicable settlement  to\t diffuse  and  sort  out  the  above<br \/>\ndifficulty.\n<\/p>\n<p>     The appeals  are  accordingly dismissed. In view of the<br \/>\nabove directions,  the\tdirection  for\tview  of  the  above<br \/>\ndirections, the\t direction for\tcontempt issued\t by the high<br \/>\nCourt  may   not  be   enforced.  However,   the  appellant-<br \/>\nCorporation shall  regularise their  service and  it will be<br \/>\nsubject to the suggestions made hereinbefore.
