Yousaf, Advocate<br \/>\n         for the petitioner.\n<\/p>\n<p>          Mr. Shilesh Gupta, DAG Punjab.\n<\/p>\n<p>          for respondent.\n<\/p>\n<p>Rajan Gupta, J(Oral)<\/p>\n<p>          Petitioner has sought quashing of FIR No. 111,<\/p>\n<p>dated 12.04.2007 registered under Sections 363, 366 of<\/p>\n<p>Indian Penal Code at Police Station Maqsudan, District<\/p>\n<p>Jalandhar.   The FIR which was lodged by the father of<\/p>\n<p>Daljeet Kaur alleges that on the intervening night of 10th<\/p>\n<p>and 11th of November, 2007, the complainant along with his<\/p>\n<p>wife Harjinder Kaur     and daughter Daljeet Kaur along with<\/p>\n<p>other children was sleeping as usual. At about 5:30 a.m<\/p>\n<p>when the complainant woke up, he saw that his daughter<\/p>\n<p>Daljeet   Kaur was missing.    The complainant told his wife<\/p>\n<p>that Daljeet kaur was missing.     After searching the whole<\/p>\n<p>house complainant could not find his daughter. He reported<\/p>\n<p>the matter to the police, stating that he was quite sure that<br \/>\n Crl.Misc.No.M-2237 of 2008                        (2)<\/p>\n<p>Neeraj Kumar, petitioner herein, had taken              away        the<\/p>\n<p>daughter of the complainant. The complainant also alleged<\/p>\n<p>that his daughter had taken away Rs. 95,000\/- and 5 Tolas<\/p>\n<p>of gold.\n<\/p>\n<p>           After   completion   of    investigation     the     police<\/p>\n<p>presented the challan in the Court of Competent jurisdiction<\/p>\n<p>under Sections 363, 366 of Indian Penal Code.                      After<\/p>\n<p>presentation of the challan, petitioner preferred present<\/p>\n<p>petition before this Court in which further proceedings<\/p>\n<p>before the trial court were stayed on 4.02.2008. Learned<\/p>\n<p>counsel for the petitioner has submitted that he had married<\/p>\n<p>Daljeet Kaur and they were living happily in his matrimonial<\/p>\n<p>home.      Even a female child has been born to them on<\/p>\n<p>10.01.2008.\n<\/p>\n<p>           Learned   counsel    submits    that    in   facts       and<\/p>\n<p>circumstances of the case, no offence under Sections 363<\/p>\n<p>and 366 is made out.      He has relied upon the judgment,<\/p>\n<p>reported as Manish Singh vs. State Govt. of Nct &amp; Ors,<\/p>\n<p>2006(1)      RCR(Criminal)      653       in   support        of    his<\/p>\n<p>contentions.\n<\/p>\n<p>           On the other hand, learned State counsel submits<\/p>\n<p>that since challan has already been presented, the trial may<\/p>\n<p>be allowed to continue. However, on instructions from Head<\/p>\n<p>Constable, Kulbir Singh who is present in Court he has<br \/>\n Crl.Misc.No.M-2237 of 2008                    (3)<\/p>\n<p>fairly admitted that the complainant Daljeet Kaur is living<\/p>\n<p>with the petitioner at present.\n<\/p>\n<p>            After hearing the counsel for the parties, I am of<\/p>\n<p>the considered view that despite the fact that the Daljeet<\/p>\n<p>Kaur was about 17 \u00bd years of age at the time of alleged<\/p>\n<p>occurrence, she had accompanied the accused of her own<\/p>\n<p>volition.    It cannot be said that she was enticed or<\/p>\n<p>kidnapped by the petitioner.
