{"id":165091,"date":"2011-09-14T00:00:00","date_gmt":"2011-09-13T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/durganand-mishra-ors-vs-the-state-of-bihar-ors-on-14-september-2011"},"modified":"2016-11-13T02:05:05","modified_gmt":"2016-11-12T20:35:05","slug":"durganand-mishra-ors-vs-the-state-of-bihar-ors-on-14-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/durganand-mishra-ors-vs-the-state-of-bihar-ors-on-14-september-2011","title":{"rendered":"Durganand Mishra &amp; Ors vs The State Of Bihar &amp; Ors. on 14 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Durganand Mishra &amp; Ors vs The State Of Bihar &amp; Ors. on 14 September, 2011<\/div>\n<pre>                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                    Miscellaneous Jurisdiction Case No.1291 of 2011\n                               Durganand Mishra &amp; Ors\n                                         Versus\n                              The State Of Bihar &amp; Ors.\n                                          with\n                     Civil Writ Jurisdiction Case No.6331 of 2011\n                              Vijay Kumar Mishra &amp; Anr\n                                         Versus\n                              The State Of Bihar &amp; Ors\n\n\n7   14.9.2011<\/pre>\n<p>               Heard learned counsel for the petitioners in the<\/p>\n<p>                contempt matter.\n<\/p>\n<p>                            This petitioners of the contempt petition have<\/p>\n<p>                come to this court for initiating a contempt proceeding for<\/p>\n<p>                non-compliance     of the order      passed   in CWJC No.<\/p>\n<p>                15938\/2010.\n<\/p>\n<p>                            The writ petition being CWJC No. 6331\/2011 has<\/p>\n<p>                been filed for quashing the order, dated 28.3.2011by which the<\/p>\n<p>                writ petitioners have been asked to deposit the award amount<\/p>\n<p>                granted in lieu of the acquisition of 67.3865 decimals of land<\/p>\n<p>                which amounts to Rs. 60,44,577\/-. Apparently the petitioners<\/p>\n<p>                of both the cases have been filing writ petition in this court<\/p>\n<p>                without explaining all the facts and bringing to the notice of<\/p>\n<p>                the court that there is an inter-se dispute between the parties.<\/p>\n<p>                The writ petitioners have stated that in fact that a suit for<\/p>\n<p>                declaration of the title is also pending with respect to the<\/p>\n<p>                properties under acquisition.\n<\/p>\n<p>                              This court had earlier also passed an order, dated<\/p>\n<p>                7.5.2010 that payment should be made only after verification<\/p>\n<p>                and due execution of bond by the petitioners or the parties<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>who were receiving the payments of the award amount.<\/p>\n<p>            The whole problem has arisen due to piece meal<\/p>\n<p>application of mind by the authorities. In cases where there is<\/p>\n<p>a dispute with respect to title and possession of lands which<\/p>\n<p>are sought to be acquired, the authorities concerned should<\/p>\n<p>ensure that all the parties are heard and thereafter pass an<\/p>\n<p>appropriate order. The order of the court, dated 7.5.2010<\/p>\n<p>passed in CWJC No. 7565\/2010 and the order of the court,<\/p>\n<p>dated 6.10.2010 passed in CWJC No. 15938 of 2010 had<\/p>\n<p>specifically directed the competent authority to take steps to<\/p>\n<p>decide the issues in accordance with law after hearing all the<\/p>\n<p>parties. This was not done by the competent authority.<\/p>\n<p>            The provisions of the National Highways Act,<\/p>\n<p>1956 envisages that if there is a dispute regarding<\/p>\n<p>apportionment of the money to be paid to the parties<\/p>\n<p>concerned, then the matter may be referred to the competent<\/p>\n<p>civil court. However, since there is a specific order of this<\/p>\n<p>court that the Land Acquisition Officer should at least hear the<\/p>\n<p>parties once to satisfy himself regarding the document of title<\/p>\n<p>with respect to the lands in question, I direct that the Land<\/p>\n<p>Acquisition Officer should decide the matter within a period<\/p>\n<p>of three months on receipt of a copy of this order.<\/p>\n<p>            The petitioners of the writ petition and the<\/p>\n<p>contempt petition are directed to produce a copy of this order<\/p>\n<p>before the competent authority.\n<\/p>\n<p>            List these cases under the same heading on<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>        4.1.2012.\n<\/p>\n<p>                        At this stage I may make it clear that the Land<\/p>\n<p>        Acquisition Officer would be free to take assistance of the<\/p>\n<p>        Circle Officer or any revenue authority to determine the issue<\/p>\n<p>        in question.
