The substantial<br \/>\nquestions of law, which are sought to be raised and subsequently<br \/>\nplaced on record, are as under:\n<\/p>\n<p>(A)\tWhether<br \/>\nthe learned first Appellate Court had not overlooked the issue<br \/>\nregarding under Section 127, 128, 130, 186, 188, 286 and 315 of the<br \/>\nP.W.D. Manual and the Bombay Irrigation Act under Section 4 &amp; 15<br \/>\nare not followed by the respondent forest department at the time of<br \/>\nconstructing the &#8216;forest pond&#8217;?\n<\/p>\n<p>(B)\tWhether<br \/>\nthe learned first Appellate Court had not erred in deciding that this<br \/>\nis an &#8216;Act of God&#8217; and not part of carelessness and negligence of the<br \/>\nopponents?\n<\/p>\n<p>2.\tHowever,<br \/>\nfrom bare perusal of the record as well as considering the<br \/>\nsubmissions, learned advocate has not been able to point out anything<br \/>\nfrom the material which can be said to be substantial question of<br \/>\nlaw, and as a matter of fact, as reflected in the impugned judgment<br \/>\nand order which has been discussed in detail in para 5, the present<br \/>\nappellant &#8211; respondent failed to prove even the damages.<br \/>\nTherefore, considering the well accepted principle regarding the<br \/>\nscope of second appeal as observed by the Hon&#8217;ble Apex Court in a<br \/>\njudgment reported in AIR 2006 Supreme Court P. 2872, this<br \/>\nSecond Appeal cannot be entertained as there is no substantial<br \/>\nquestion of law involved and the present appeal deserves to be<br \/>\ndismissed in limine   and according stands dismissed.
