Misc.Civil Application No. 974 of 2003\n          MR HS MUNSHAW for Petitioner No. 1-2\n          MR AK CLERK for Respondent No. 1\n\n\n     --------------------------------------------------------------\n\n\n                 CORAM : MR.JUSTICE M.S.SHAH\n\n\n                 Date of Order: 02\/05\/2003\n\n\nORAL ORDER<\/pre>\n<p>     An advance copy of this application was served<br \/>\n     upon Mr AK Clerk, learned counsel who had appeared for<br \/>\n     the opponent herein (original petitioner) at the hearing<br \/>\n     of the main petition i.e.       Special Civil Application<br \/>\n     No.8482 of 2002, which was disposed of by order dated<br \/>\n     14.10.2002.   The main petition was filed for challenging<br \/>\n     the suspension order dated 17.8.2002. While disposing of<br \/>\n     the main petition, this Court did not interfere with the<br \/>\n     order of suspension but directed that if at all the<br \/>\n     Corporation is to institute a departmental        inquiry<br \/>\n     against the original petitioner, the Corporation shall<br \/>\n     commence the    departmental   inquiry   by   issuing   a<br \/>\n     charge-sheet   by   30.11.2002 and shall complete the<br \/>\n     departmental inquiry by 10.4.2003.\n<\/p>\n<p>     2.The present application came to be filed on<br \/>\n     8.4.2003 stating that the charge-sheet has been issued to<br \/>\n     the original petitioner on 30.11.2002 and that some more<br \/>\n     time will be required for completion of the departmental<br \/>\n     inquiry.\n<\/p>\n<p>     3.Mr   Clerk    states   that   the   opponent    herein,<br \/>\n original petitioner, has taken away the papers from him<br \/>\nand, therefore, he is not in a position to appear in the<br \/>\nmatter.    He   further   states that the opponent is<br \/>\npersonally present before the Court.    Accordingly, the<br \/>\nCourt has heard the opponent as the party in person.\n<\/p>\n<p>4.Rule.    The   opponent   party-in-person   waives<br \/>\nservice of Rule.\n<\/p>\n<p>5.According to the opponent-original petitioner,<br \/>\nsince the charge-sheet was issued on 30.11.2002 and he<br \/>\nhas already filed reply to the same in December, 2002,<br \/>\nthe Corporation had sufficient time to complete the<br \/>\ndepartmental inquiry.    He further submits that 8 months<br \/>\nhave already passed since the order of suspension was<br \/>\nimplemented on 20.8.2002 but still the opponent-original<br \/>\npetitioner is being paid subsistence allowance at the<br \/>\nrate of 50% only, though the Corporation is required to<br \/>\npay him subsistence allowance at the rate of 75% upon<br \/>\ncompletion of six months from the date of suspension as<br \/>\nthe delay is not attributable to the opponent-original<br \/>\npetitioner.   The opponent further states that no action<br \/>\nhas been taken against the other erring Officers.\n<\/p>\n<p>6.Mr Munshaw for the Corporation states that since<br \/>\nthe Inquiry Officer has been appointed in March, 2003,<br \/>\nextension may be granted till 30.9.2003 for completion of<br \/>\nthe departmental inquiry.\n<\/p>\n<p>7.Having heard the learned      counsel   for   the<br \/>\nCorporation and opponent as party-in-person, it appears<br \/>\nto the Court that since there is no allegation that the<br \/>\nopponent-original petitioner has not cooperated, the<br \/>\nCorporation is required to examine his case for payment<br \/>\nof   subsistence   allowance at the higher rate upon<br \/>\ncompletion of six months from the date of suspension.\n<\/p>\n<p>8.Subject to the aforesaid observation, the time<br \/>\nlimit for completion of the departmental inquiry against<br \/>\nopponent Ishwarbhai Hargovindbhai Prajapati pursuant to<br \/>\nthe chargesheet dated 30.11.2002 is extended till 30th<br \/>\nSeptember, 2003.\n<\/p>\n<p>It   is   clarified   that if opponent-original<br \/>\npetitioner extends cooperation for expeditious disposal<br \/>\nof the inquiry, any application in future for extension<br \/>\nof time will not be viewed leniently.\n<\/p>\n<p>9.The   application is accordingly disposed of.<br \/>\nSubject of the aforesaid observations, rule is         made<br \/>\nabsolute with no order as to costs.\n<\/p>\n<p> (M.S.
