Justice ANTONY DOMINIC\n\n Dated :01\/11\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                W.P.(C) NO. 32982 OF 2010 (W)\n                =====================\n\n           Dated this the 1st day of November, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>      In this writ petition, what is under challenge is Ext.P7, a<\/p>\n<p>prohibitory order issued alleging violation of the provisions<\/p>\n<p>contained in Act 28 of 2008. It is seen that subsequently for the<\/p>\n<p>very same reasons, Ext.P8 show cause notice has been issued by<\/p>\n<p>the District Collector, calling upon the petitioner to show cause<\/p>\n<p>why action shall not be initiated. On receipt of the show cause<\/p>\n<p>notice, petitioner has filed Ext.P9 application as well. It is during<\/p>\n<p>the pendency of such proceedings that the petitioner has filed this<\/p>\n<p>writ petition challenging Ext.P7.\n<\/p>\n<p>      2.    In my view, Ext.P7 has been issued only to ensure that<\/p>\n<p>further works are not carried out by the petitioner and cannot be<\/p>\n<p>impugned. Having regard to the fact that subsequently show<\/p>\n<p>cause notice has been issued and the petitioner has filed his<\/p>\n<p>explanation to the show cause notice, at this stage, all that is<\/p>\n<p>required is that the proceedings pursuant to Ext.P8 should be<\/p>\n<p>finalised by the 3rd respondent.\n<\/p>\n<p>      Therefore, I dispose of this writ petition directing that on the<\/p>\n<p>WPC No. 32982\/10<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>production of a copy of this judgment along with a copy of this<\/p>\n<p>writ petition, the 3rd respondent will issue notice to the petitioner<\/p>\n<p>and the 4th respondent and untramelled by the findings in Ext.P7,<\/p>\n<p>finalise the proceedings pursuant to Ext.P8, as expeditiously as<\/p>\n<p>possible, at any rate within 4 weeks thereafter.<\/p>\n<p>                                        ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court John Mathai vs The Village Officer on 1 November, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 32982 of 2010(W) 1.
