Whether the entire area of the Housing Cooperative Applicant can consult list of notified roads \/stretches for<br \/>\n         Society New Delhi South Extension Part-I falls       the information sought through this point, said list is<br \/>\n                                                              available on the web site of MCD, same is also<br \/>\n         in the area of &#8220;mixed land use&#8221;?                     available in the open market for general public and<br \/>\n                                                                      same can also be obtained from this office on<br \/>\n                                                                      deposition of Rs.12\/- for 06 documents @ Rs.2\/- per<br \/>\n                                                                      document, with the Citizen Service Bureau at House<br \/>\n                                                                      Tax Building, Ring Road, Lajpat Nagar-III, New<br \/>\n                                                                      Delhi, and on submission of cash receipt of the same<br \/>\n                                                                      in this office, as per provisions of RTI Act-2005.\n<\/p>\n<p>2.    If the entire area of the Housing Cooperative Society &#8211; Do &#8211;\n<\/p>\n<blockquote><p>           New Delhi South Extension Part-I does not fall<br \/>\n           in the area of &#8220;mixed land use&#8221; then which part<br \/>\n           is permitted as &#8220;mixed land use&#8221;?\n<\/p><\/blockquote>\n<p>3.    If the entire area or any part thereof of the Housing This point relates to Town Planning<br \/>\n           Cooperative Society New Delhi South                  Department. However, different roads\/<br \/>\n           Extension Parr-I does fall in the area of &#8220;mixed     stretches have been notified for<br \/>\n           land use&#8221; then when was the same notified and        commercial \/ mix land use \/ P.S.S. vide<br \/>\n           by which authority and under which provision         Notifications dated 15-9-2006 and 12-4-\n<\/p>\n<p>           the said authority has so notified?                  2007.\n<\/p>\n<p> Grounds of the First Appeal:\n<\/p>\n<p>The Information Officer responding Officer has sought to evade a reply to query no. 1 and 2 by<br \/>\nmentioning of applicant.\n<\/p>\n<p>Order of the FAA:\n<\/p>\n<p>&#8220;The Appeal was heard in detail, Representative of the PIO informed that reply to RTI application has<br \/>\nalready been provided to the appellant vide letter dated 14.12.2010 He further stated that the appellant was<br \/>\nasked to deposit 01 Rs.12\/- for 06 documents with Citizen Service Bureau. Appellant has deposited the<br \/>\nsame and copies of documents sought have been sent to him vide letter dated 25.01.2011.<br \/>\nIn view of above, the appeal is disposed of with the direction that a copy of RTI application be forwarded<br \/>\nto Town Planning Department for providing to the appellant in respect of Point No.3 of the application.&#8221;\n<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p>The appellant not satisfied with prior information.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Suresh Kumar Gupta;\n<\/p>\n<p>Respondent: Mr. Ravi Kant Gupta, AE on behalf of Mr. A. K. Mittal, PIO &amp; SE-I;<br \/>\nThe respondent has given information on queries 1 &amp; 2 as per available records. As far as query-3 is<br \/>\nconcerned the respondent has transferred the RTI application to PIO Town Planning Department vide<br \/>\nletter on 24\/11\/2010 vide letter no. 3098. The appellant states that he has not received any information on<br \/>\nquery-3 from Town Planning Department. The respondent states that he has given the date of notification<br \/>\nbut as regard the authority how had notified and the provisions under which the notification was made had<br \/>\nto be clarified by the Town Planning Department.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      PIO Town Planning Department is directed to provide the information on query-3 as<br \/>\ndescribed above to the appellant before 10 July 2011.<br \/>\nThis decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                           21 June 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
