The  said judgment  and order was<br \/>\nchallenged before the learned Sessions Judge by way of filing Appeal<br \/>\nNo. 2 of 2009 which was dismissed by the learned Addl.Sessions Judge,<br \/>\nFast Track Court No.2, Nadiad by judgment and order dated 22.12.2009.<br \/>\n Both these orders are challenged in this  Revision.\n<\/p>\n<p>\t\tRULE.\n<\/p>\n<p>2.\t\tOriginal<br \/>\ncomplainant has also preferred Revision Application against the<br \/>\njudgment and orders being  Criminal Revision Application No.527 of<br \/>\n2008.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by the learned Advocate for the petitioner Mr  Chirag B<br \/>\nPatel that  the matter has been amicably settled between the parties.<br \/>\n He has placed on record the settlement pursis which is ordered to be<br \/>\ntaken on record.  Mr  Murali Devnani, learned Advocate appears on<br \/>\nbehalf of the original complainant.  It is submitted by him that the<br \/>\nmatters are settled between the parties and as per  the settlement<br \/>\nthe full and final amount in question has been received by the<br \/>\ncomplainant and he has no grievance against the present accused.\n<\/p>\n<p>4.\t\tThis<br \/>\ncourt has gone through the consent terms produced by the petitioners.<br \/>\n The accused  was present before the court.  Signature of the<br \/>\ncomplainant and the accused were identified by the respective learned<br \/>\nadvocates.  When the matter is settled between the parties and when<br \/>\nthere is no dispute regarding the amount in question between the<br \/>\nparties and full and final payment is also made, in light of the<br \/>\namended section 147 of the Negotiable Instruments Act and in light of<br \/>\n the decision of the Hon&#8217;ble Supreme Court  in the case of <a href=\"\/doc\/1981864\/\">Vinay<br \/>\nDevanna Nayak  v. Ryot Seva Sahakari Bank Ltd.<\/a> (2007(0) GLHEL-SC<br \/>\n40168.\n<\/p>\n<p>this Revision Application is required to be allowed and is<br \/>\naccordingly allowed.  The impugned  judgment and orders passed by the<br \/>\nlearned Addl.Sessions Judge, Nadiad and  of the learned Judicial<br \/>\nMagistrate First Class, Thasra  are quashed and set aside.   The<br \/>\nrevisionist is acquitted of the offence under section 138 of the<br \/>\nNegotiable Instruments Act.  So far as the refund of fine paid by the<br \/>\naccused shall be refunded to him.
