Petitioner- Respondent\n\n\n               For the Appellants:-      Mr. Piyush Lall, AC to AAG-1\n               For the Respondent:-      Mr. Mrigank Mauli, Advocate\n                               ----------------------------------\n<\/pre>\n<p>06.   02.08.2011             The matter arises out of the dispute<\/p>\n<p>                   between the appellant State and the respondent-<\/p>\n<p>                   contractor with regard to levy amount of Rs.<\/p>\n<p>                   15,41,119\/- vide Memo No. 430       dated 4.10.2007<\/p>\n<p>                   (Annexure-17 to the writ petition) issued by the<\/p>\n<p>                   Executive Engineer, Durgawati Right Side Canal<\/p>\n<p>                   Division, whereby the respondent has been asked to<\/p>\n<p>                   refund the amount alleged to have been excess paid<\/p>\n<p>                   following the direction of this Court in C.W.J.C.<\/p>\n<p>                   No.7309 of 2006.\n<\/p>\n<p><span class=\"hidden_text\">                      2<\/span><\/p>\n<p>          The main contention on behalf of the State<\/p>\n<p>Mr. Piyush Lall is that there was a dispute with<\/p>\n<p>regard to execution of the work by respondent-<\/p>\n<p>contractor and also with regard to the quality of the<\/p>\n<p>soil, whether it is soft and hard. As the disputed<\/p>\n<p>question of facts have been involved in this case the<\/p>\n<p>respondent has to approach the concerned Tribunal<\/p>\n<p>under the Bihar Public Works Contract Dispute<\/p>\n<p>Tribunal Act, 2008.\n<\/p>\n<p>          Learned counsel appearing on behalf of the<\/p>\n<p>respondent submits that in view of the order passed<\/p>\n<p>by this Court in C.W.J.C. No. 7309 of 2006 a<\/p>\n<p>representation has been made on the question of<\/p>\n<p>demand. Accordingly the said representation was<\/p>\n<p>disposed of. This Court is of the opinion that there<\/p>\n<p>are disputed question of fact which has to be<\/p>\n<p>decided by an individual Forum as this Court is not<\/p>\n<p>an appropriate Forum under Article 226 of the<\/p>\n<p>Constitution of India to go into the disputed<\/p>\n<p>question of facts.\n<\/p>\n<p>          Under      the   aforesaid   circumstances   it<\/p>\n<p>would suffice if the appellant State is directed to<\/p>\n<p>approach the Tribunal under the provision of the Act<\/p>\n<p>indicating facts of its case and the Tribunal shall<\/p>\n<p>dispose of the same in accordance with law. Liberty<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>       is also granted to respondent contractor to contest<\/p>\n<p>       the   matter   before   the   Tribunal   by   filing   an<\/p>\n<p>       appropriate reply. It is also made clear that Tribunal<\/p>\n<p>       shall dispose of the matter as per the law and till the<\/p>\n<p>       order is passed by the Tribunal no coercive steps<\/p>\n<p>       shall be taken against the respondent herein.<\/p>\n<p>                 With the above observation the L.P.A.<\/p>\n<p>       stands disposed of.\n<\/p>\n<\/p>\n<p>                                     (T.
