Justice J.M.JAMES\n\n Dated :15\/11\/2006\n\n O R D E R\n                            J.M.JAMES, J.\n\n                            -------------------\n\n                       W.P.(C). 24694\/2006\n\n                            --------------------\n\n             Dated this  15th day of November, 2006\n\n\n                           JUDGMENT\n<\/pre>\n<p>             The   fourth   respondent,   Kuthiyathodu   Grama<\/p>\n<p>Panchayat, had issued Exts. P11 and P12 stoppage orders,<\/p>\n<p>directing   the   writ   petitioner,   who   is   operating   a   peeling<\/p>\n<p>shed in the locality,  as the functioning of the peeling shed<\/p>\n<p>of the writ petitioner is causing environmental pollution of<\/p>\n<p>the area.\n<\/p>\n<\/p>\n<p>      2.     The   learned   counsel   for   the   fourth   respondent<\/p>\n<p>submits   that   condition   No.11   contained     in   Ext.P2,<\/p>\n<p>directing   the   writ   petitioner   to   provide   the   facilities<\/p>\n<p>mentioned therein for effluent   collection, treatment, etc.,<\/p>\n<p>on   or   before   31.12.2005,     had   not   been   complied   with.<\/p>\n<p>Owing   to   the   said   reason,   the   fourth   respondent   did   not<\/p>\n<p>give licence for the working of the peeling shed of the writ<\/p>\n<p>petitioner.     The   counsel     further     submitted   that   the<\/p>\n<p>inhabitants   of   the   locality   are   agitating   because   of   the<\/p>\n<p>W.P.(C).24694\/2006<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>pollution, being caused by the functioning of the peeling<\/p>\n<p>shed   of   the   writ   petitioner   and   the     inhabitants     also<\/p>\n<p>made a complaint before the Ombudsman.<\/p>\n<p>      3.     The   learned   counsel   appearing   for   the   writ<\/p>\n<p>petitioner     submitted   that     what   had   been   directed<\/p>\n<p>through   condition   No.11   of   Ext.P2   had   already   been<\/p>\n<p>complied   with   and   despite   the   opposition,   the   lying   of<\/p>\n<p>pipes  for  the effluent removal, had also been completed.<\/p>\n<p>Therefore, the Pollution  Control  Board of Alapuzha, had<\/p>\n<p>collected an amount of Rs.7,500\/-, as could be seen from<\/p>\n<p>Ext.P7 receipt,  by the Environmental Engineer, Pollution<\/p>\n<p>Control   office,   Alapuzha.     The   counsel   further   submits<\/p>\n<p>that this amount had been realised only as a penalty fees<\/p>\n<p>for the delayed compliance of the directions issued to it.<\/p>\n<p>It is also   submitted that the consent from the Pollution<\/p>\n<p>Control   Board   is   only   a   formality   and   the   same   will   be<\/p>\n<p>obtained at the earliest and will be furnished before the<\/p>\n<p>fourth respondent, Panchayat.\n<\/p>\n<p>\nW.P.(C).24694\/2006<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>      4.     In the above facts situation,  I direct the third<\/p>\n<p>respondent,   the   Environmental   Engineer,   Kerala   State<\/p>\n<p>Pollution   Control   Board,   Alappuzha,   to   conduct     an<\/p>\n<p>inspection   and satisfy   whether the conditions, required<\/p>\n<p>to   be   complied   with   by   the   writ   petitioner,   are<\/p>\n<p>satisfactorily completed,   as submitted before this Court<\/p>\n<p>during   the   consideration     of   the   writ   petition.     In   such<\/p>\n<p>event, on having satisfied of the compliance of the legal<\/p>\n<p>requirements, issue  necessary consent for the continued<\/p>\n<p>functioning   of   the   peeling   shed   of   the   writ   petitioner.<\/p>\n<p>Inspection,   if any required, shall be done at the earliest<\/p>\n<p>and   the   consent   issued   thereafter.     This   shall   be<\/p>\n<p>completed   within   one   month   from   the   date   of<\/p>\n<p>production   of   a   copy   of   this   judgment,   before   the   third<\/p>\n<p>respondent.\n<\/p>\n<\/p>\n<p>      5.     On receipt of the consent letter from the third<\/p>\n<p>respondent, the writ petitioner shall furnish it before the<\/p>\n<p>fourth respondent, Kuthiyathodu Grama Panchayat, who<\/p>\n<p>W.P.(C).24694\/2006<\/p>\n<p><span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>shall   then   issue   the   required   licence,   as   per   the<\/p>\n<p>Panchayat Raj Act and Rules.\n<\/p>\n<\/p>\n<p>        6.
