It<br \/>\nis the case of the petitioner that the workman had earlier filed<br \/>\napplication \/ complaint under Section 33-A of the I.D.Act, 1947,<br \/>\nhowever, subsequently, the said application was unconditionally<br \/>\nwithdrawn. After having unconditionally withdrawn the said<br \/>\napplication \/ complaint, the workman subsequently filed another<br \/>\napplication \/ complaint under Section 33-A for the same dispute and<br \/>\nsame relief. It is the case of the petitioner that such an<br \/>\napplication \/ complaint would not be maintainable and would be barred<br \/>\nby principle of res-judicata or<br \/>\nprinciple analogous to the said principle. Hence, RULE. There<br \/>\nshall be interim relief on condition that the petitioner shall comply<br \/>\nwith the provisions under Section 17-B of the I.D.Act, 1947. In view<br \/>\nof the judgment of the Hon&#8217;ble  Supreme Court in the case of Jaipur<br \/>\nJilla Sahkari Bhoomi Vikas Bank Ltd. V\/s. Ramgopal Sharma &amp; Ors.<br \/>\nreported in (2002) 2<br \/>\nSCC 244 when complaint under<br \/>\nSection 33-A is allowed, the order would imply that the employer is<br \/>\nobliged to reinstate the workman. In present case, however, there is,<br \/>\nin the impugned order dated 31.7.2008, specific direction granting<br \/>\nreinstatement. Hence, provisions under Section 17-B would become<br \/>\napplicable. In the present case, there is a clear direction to<br \/>\nreinstate the respondent.
