No. 839 OF 2006\n                  --------------------------------------------\n                 Dated this the 21st day of October, 2008\n                                                               C.R.\n                                JUDGMENT\n<\/pre>\n<p>Ramachandran Nair,J.\n<\/p>\n<\/p>\n<p>      Appeal is filed by the insurance company against the award of<\/p>\n<p>MACT directing the appellant to pay compensation for the death of son<\/p>\n<p>of the first respsondent, the remaining respondents being siblings of the<\/p>\n<p>deceased. Claim Petition was filed by respondents under Section 163A<\/p>\n<p>of the M.V. Act        and the MACT granted compensation of Rs.<\/p>\n<p>1,84,500\/- and since the motorbike was covered by a comprehensive<\/p>\n<p>policy (B policy), the appellant was directed to deposit compensation.<\/p>\n<p>It is against this part of the award that the appellant has filed this<\/p>\n<p>appeal. We have heard standing counsel appearing for the appellant<\/p>\n<p>and counsel appearing for the respondents.\n<\/p>\n<p>      2. Counsel appearing for the appellant cited decision of the<\/p>\n<p>Supreme Court in <a href=\"\/doc\/309619\/\">NEW INDIA ASSURANCE CO. LTD. V. JAYA,<\/a><\/p>\n<p>(2002 ) 1 K.L.T. 596 (SC), and also Full Bench decision of this Court<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>in <a href=\"\/doc\/542594\/\">MATHEW JOSEPH V. JANAKI,<\/a> (2007) 1 K.L.T. 747 (FB) and<\/p>\n<p>contended that insurance company has no liability to pay compensation<\/p>\n<p>for the death of rider of a motor-cycle though the policy is a<\/p>\n<p>comprehensive policy (B policy).         Counsel appearing for the<\/p>\n<p>respondents on the other hand referred to Division Bench decision of<\/p>\n<p>this Court in NEW INDIA ASSURANCE CO.LTD. V. HYDROSE,<\/p>\n<p>(2008) 3 K.L.T. 778 and <a href=\"\/doc\/1667378\/\">ORIENTAL INSURANCE CO.LTD. V.<\/p>\n<p>SMT. BABY AND ORS,<\/a> (2008) 4 KHC 103 (DB) and contended that<\/p>\n<p>appellant is liable to pay compensation to the legal representatives of<\/p>\n<p>the victim under the Comprehensive Policy.\n<\/p>\n<p>      3. In the decision of the Supreme Court cited by the appellant, all<\/p>\n<p>what is decided is that higher compensation over the limit can be<\/p>\n<p>claimed only on payment of additional premium. In the Full Bench<\/p>\n<p>decision cited by the appellant, this Court has in fact held that<\/p>\n<p>gratuitous passengers in transport vehicles including motorcycles, can<\/p>\n<p>have coverage only when a comprehensive policy or extended policy as<\/p>\n<p>might be possible to be issued has been availed by the owner of the<\/p>\n<p>vehicle. Since the appellant has contested the liability on the ground<\/p>\n<p>that it is not covered by conditions of policy, we have referred to the<\/p>\n<p>conditions of B policy issued to the registered owner of the vehicle in<\/p>\n<p><span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>this case. Section II of the Conditions of policy providing for liability<\/p>\n<p>to third parties is as follows:\n<\/p>\n<\/p>\n<blockquote><p>                    Section II- Liability to Third Parties.\n<\/p><\/blockquote>\n<blockquote><p>                    (1)&#8230;&#8230;.\n<\/p><\/blockquote>\n<blockquote><p>                    (3) In terms of and subject to the limitations of the<br \/>\n                    indemnity which is granted by this Section to the<br \/>\n                    Insured the company will indemnify any Driver who<br \/>\n                    is driving the Motor Cycle on the insured&#8217;s order or<br \/>\n                    with his permission provided that such Driver shall as<br \/>\n                    though he were the insured observe fulfil and be<br \/>\n                    subject to the terms exceptions and conditions of this<br \/>\n                    Policy in so far as they can apply.\n<\/p><\/blockquote>\n<blockquote><p>                    (4) In the event of death of any person entitled to<br \/>\n                    indemnity under this Policy the company will in<br \/>\n                    respect of the liability incurred by such person<br \/>\n                    indemnify his personal representatives in the terms of<br \/>\n                    and subject to the limitations of this Policy provided<br \/>\n                    that such personal representatives shall as though<br \/>\n                    they were the insured observe fulfil and be subject to<br \/>\n                    theterms, exceptions and conditions of this Policy in<br \/>\n                    so far as they can apply.\n<\/p><\/blockquote>\n<blockquote><p>                    &#8230;&#8230;..\n<\/p><\/blockquote>\n<p>It is clear from the above that coverage under the Policy is extended to<\/p>\n<p>a driver who is allowed to drive the vehicle with the permission of the<\/p>\n<p>insured and that such driver observes all the formalities and conditions<\/p>\n<p>required to be complied with by the insured. In fact clause (4) entitles<\/p>\n<p><span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>legal representatives to claim compensation in the event of death of a<\/p>\n<p>person who is covered by the Policy. Even though counsel for the<\/p>\n<p>appellant submitted that Section II of the Policy deals with liability to<\/p>\n<p>third parties and rider of motor bike in this case is not a third party, we<\/p>\n<p>are unable to accept this contention because the above terms of the<\/p>\n<p>policy specifically cover liability for a driver treating him as a third<\/p>\n<p>party. In other words, a driver other than the insured is specifically<\/p>\n<p>covered by the policy subject to the condition that he at the time of the<\/p>\n<p>accident was driving the vehicle on being engaged by the insured or<\/p>\n<p>with his consent. The insurance company can disown liability for the<\/p>\n<p>death of driver driving a private vehicle only if it is proved that he was<\/p>\n<p>driving the vehicle without being engaged or without authority of the<\/p>\n<p>insured.    Similarly other conditions such as driver should have a<\/p>\n<p>driving licence and at the time of driving the vehicle, he should not be<\/p>\n<p>under the influence of alcohol, will be applicable for claiming the<\/p>\n<p>benefit. Another claim raised by the insurance company is that income<\/p>\n<p>of the deceased was Rs. 9000\/- which is above the limit which entitles<\/p>\n<p>for maintaining a claim under Section 163A of the MV Act. However,<\/p>\n<p>counsel for the respondents submitted that application was amended<\/p>\n<p>reducing the monthly income to Rs. 3300\/- which is within the limit for<\/p>\n<p><span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>making claim under Section 163A of the Act. We do not think, after<\/p>\n<p>permitting the respondents to reduce the monthly income of the<\/p>\n<p>deceased, appellant can raise this contention in the appeal. Further<\/p>\n<p>appellant did not adduce any evidence that the deceased had income<\/p>\n<p>above the limit that entitles him for maintaining a petition under<\/p>\n<p>Section 163A of the Act.
