RULE.\n<\/p>\n
\tLearned APP Mr. J.K. Shah waives service of notice of Rule for the
\n\trespondent – State.\n<\/p>\n
This
\n\tapplication is filed under Section 438 of the Code of Criminal
\n\tProcedure in connection with First Information Report registered as
\n\tI-C.R. No.32\/2011 with Pradhyuman Nagar Police Station, Vadodara for
\n\tthe offences punishable under Sections 465, 467, 468 and 471 of the
\n\tIndian Penal Code.\n<\/p>\n
Learned
\n\tCounsel for the applicant submits that the
\n\tapplicant is aged about 96 years and a female accused and hence, may
\n\tbe granted anticipatory bail.\n<\/p>\n
Heard
\n\tlearned APP Mr. J.K. Shah for the respondent-State and learned
\n\tAdvocate Mr. H.N. Adarya for the complainant.\n<\/p>\n
Having
\n\theard learned Counsel for the parties and perusing the record of the
\n\tcase and taking into consideration the facts of the case, I am
\n\tinclined to grant anticipatory bail to the applicant.  The
\n\tunderstanding of the law laid down by the Hon’ble Supreme Court in
\n\tSiddharam Stalingappa Mhetre v. State of Maharashtra &
\n\tOrs.<\/a> reported in [2011]1
\n\tSCC 694 by the learned
\n\tJudge is contrary to what is pronounced. No other factor is to be
\n\tconsidered at this stage. The applicant lady is available for
\n\tinvestigation and accordingly, she is granted anticipatory bail.
\n\t This Court has also taken into consideration the law laid down by
\n\tthe Apex Court in the case of Siddharam Stalingappa Mhetre v.
\n\tState of Maharashtra & Ors.<\/a> (supra),
\n\twherein the Apex Court reiterated the law laid down by the
\n\tConstitutional Bench in the case of Shri Gurubaksh Singh
\n\tSibbia & Ors. reported in [1980]2 SCC 565.\n<\/p>\n
Learned
\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n
In
\n\tthe result, this application is allowed by directing that in the
\n\tevent of the applicant herein being arrested pursuant to FIR being
\n\tI-C.R. No.32\/2011 with Pradhyuman Nagar Police Station, Vadodara,
\n\tthe applicant shall be released on bail on furnishing a bond of
\n\tRs.10,000\/- (Rupees Ten Thousand Only) with one surety of like
\n\tamount on following conditions :-\n<\/p>\n
(a) shall
\ncooperate with the investigation and make herself available for
\ninterrogation whenever required;\n<\/p>\n
(b) shall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
(c) shall
\nat the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
(d) will
\nnot leave India without the permission of the Court and, if is
\nholding a Passport, shall surrender the same before the trial Court
\nimmediately;\n<\/p>\n
(e) It
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits.\n<\/p>\n
(f)
\ndespite this order, it would be open for the Investigating Agency to
\napply to the competent Magistrate, for police remand of the
\napplicant.  The applicant shall remain present before the learned
\nMagistrate on the first date of hearing of such an application and on
\nall subsequent occasions, as may be directed by the learned
\nMagistrate.  This would be sufficient to treat the accused in the
\njudicial custody for the purpose of entertaining application of the
\nprosecution for police remand.  This is, however, without prejudice
\nto the right of the accused to seek stay against an order of remand,
\nif ultimately granted, and the power of the learned Magistrate to
\nconsider such a request in accordance with law.  It is clarified that
\nthe applicant, even if, remanded to the police custody, upon
\ncompletion of such period of police remand, shall be set free
\nimmediately, subject to other conditions of this anticipatory bail
\norder.\n<\/p>\n
Rule
\n\tmade absolute.  The application is disposed of accordingly.\n<\/p>\n

\n\tService is permitted.\n<\/p>\n
