      The petitioner availed of a loan of Rs. 1 lakh from the 2nd<\/p>\n
respondent-bank in 1998.          He also availed of another loan for<\/p>\n
Rs. 20,000\/- for agricultural purposes.            The petitioner defaulted<\/p>\n
repayment of the loan amounts. The bank brought the properties<\/p>\n
belonging to the petitioner to sale, which ultimately culminated in the<\/p>\n
bank itself buying the property on 22-6-2001. The petitioner filed a<\/p>\n
writ petition.   By Ext. P1       judgment, this Court       directed the 1st<\/p>\n
respondent to dispose of the petitioner’s representation . Pursuant to<\/p>\n
Ext. P1, the 1st respondent heard the petitioner and the recovery<\/p>\n
officer of the bank.     On the date of hearing,          the 1st respondent<\/p>\n
directed the parties to think it over and to submit the exact amount<\/p>\n
that can be paid. Thereafter, although the 1st respondent issued Ext.<\/p>\n
P2 notice directing the petitioner to appear before him on 5.9.2009 at<\/p>\n
3.00 p.m., the 1st respondent passed Ext. P3 order dated 31-8-2009<\/p>\n
directing the petitioner to pay Rs. 4,10,000\/-, whereas the petitioner<\/p>\n
offered to make payment of only Rs. 3 lakhs. It is under the above<\/p>\n
circumstances, the petitioner has filed this writ petition seeking the<\/p>\n
following reliefs:\n<\/p>\n<\/p>\n
     “(a)   Issue a writ of certiorari calling for the records relating to
\n     Ext. P3 and quash the original of the same.\n<\/p><\/blockquote>\n
     (b)    writ of mandamus or any other appropriate writ, order or
\n     direction, directing the 2nd respondent to permit the petitioner to
\n     make the payments in 12 monthly equal instalments.\n<\/p><\/blockquote>\n
     (c)    writ of mandamus or any          appropriate writ, order or
\n     direction, directing the 2nd respondent to give concessions to the
\n     petitioner in repaying the loan amount.”<\/p><\/blockquote>\n
      2. Counsel for the bank stoutly opposes the prayers. According<\/p>\n

to him, the sale itself had taken place more than 7 years ago and<\/p>\n
therefore the petitioner cannot now come and say that he will pay<\/p>\n
only Rs. 3 lakhs for re-conveyance of the property. He would further<\/p>\n
submit that the bank had given further reduction in the amounts<\/p>\n
payable by the petitioner to the tune of almost Rs. 30,000\/- and it is<\/p>\n
after deducting that amount, Rs. 4,10,000\/- was arrived at. However,<\/p>\n
counsel for the bank would submit that the bank is still willing to<\/p>\n
re-convey the property provided the petitioner pays the above<\/p>\n
amount.\n<\/p>\n
      3. In view of the above submissions, the learned counsel for the<\/p>\n
petitioner seeks facility to pay that amount in instalments, which is<\/p>\n
also opposed by the learned counsel for the bank.<\/p>\n
      4. After hearing both sides, I am of opinion that the bank was<\/p>\n
very lenient to the petitioner. The petitioner is not in a position to<\/p>\n
bargain on the amount payable. The entire recovery proceedings are<\/p>\n
over and if the petitioner wants re-conveyance of the property, he has<\/p>\n
to pay the amounts as directed by the bank.              In the above<\/p>\n
circumstances, the writ petition is disposed of with the following<\/p>\n
directions:\n<\/p>\n
      The petitioner shall pay Rs. 4,10,000\/- with further interest<\/p>\n
thereon at the rate agreed upon in the original loan agreement, from<\/p>\n
the date of Ext. P3, with conveyance charges, within two months. On<\/p>\n
such payment, the bank shall re-convey the property to the petitioner.<\/p>\n
If the petitioner does not pay the amount within two months, the bank<\/p>\n
would not be liable to re-convey the property to the petitioner.<\/p>\n
