Learned advocate has contended that<br \/>\n\tdespite their being a specific recording of the stand on the part of<br \/>\n\tthe concerned Engineer of the Capital Project, Gandhinagar in<br \/>\n\trespect of the land in question and direction to the concerned<br \/>\n\tauthority disposing of the application as expeditiously as possible,<br \/>\n\tthe inaction compelled the petitioners to file contempt petition and<br \/>\n\tpresent petition, may be appreciated by the Court.\n<\/p>\n<p>Learned<br \/>\n\tAGP submitted that communication at page-31 is indicative of the<br \/>\n\taction on the part of the respondents and hence the contention of<br \/>\n\tlearned advocate for the petitioners with regard to inaction cannot<br \/>\n\tbe accepted.\n<\/p>\n<p>Be<br \/>\n\tthat as it may. This court is of the prima-facie view that the order<br \/>\n\tdated 3.9.2010 passed in Special Civil Application No. 9275 of 1993<br \/>\n\tdisposing of the matter of 1993 is not taken into right spirit and<br \/>\n\ttherefore, it is unfortunate that the petitioners are constrained to<br \/>\n\ttake out one after the other proceedings, though their cause of<br \/>\n\taction arose in the year 1993 was actually put an end to by 3.9.2010<br \/>\n\torder but that termed out mere illusory and hence, this Court is of<br \/>\n\tthe view that let there be a notice for final disposal.\n<\/p>\n<p>Notice<br \/>\n\tfor final disposal returnable on 23.09.2011. As notice is being<br \/>\n\tissued for final disposal, it is expected of all the respondent<br \/>\n\tconcerned to file respective affidavit-in-reply, if any, answering<br \/>\n\tthe allegations and contentions raised in the petition or else on<br \/>\n\tthe next date of hearing, the Court would be constrained to pass<br \/>\n\tappropriate order on this petition in absence of the<br \/>\n\taffidavit-in-reply.
