JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/09\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p>&#8220;A)\tThis<br \/>\nHon&#8217;ble Court may be pleased to issue a writ of or in th nature of,<br \/>\nMandamus or any other appropriate writ,<br \/>\norder or direction, commanding\/directing respondents more<br \/>\nparticularly respondent no.1 to decide the Case No.405 of 1999<br \/>\ninstituted in connection with the said document, a copy whereof<br \/>\nfigures at Annexure &#8220;A&#8221; to the petition, at the earliest;\n<\/p>\n<p>B)\tPending<br \/>\nadmission, disposal and final hearing of the above numbered writ<br \/>\npetition, this Hon&#8217;ble Court may be pleased to direct the respondents<br \/>\nmore particularly respondent no.1 to decide the Case No.405 of 1999<br \/>\ninstituted in connection with the said document, a copy whereof<br \/>\nfigures at Annexure &#8220;A&#8221; to the petition.\n<\/p>\n<p>C)\tSuch<br \/>\nother(s) and further relief(s) which this Hon&#8217;ble Court may deem fit<br \/>\nto be granted in the interest of justice;&#8221;\n<\/p>\n<p>2.\tThe<br \/>\ncase of the petitioner is that the document executed on 27.10.1998<br \/>\nhas been impounded but in spite of proceedings being commenced and<br \/>\nreplies being filed by him, no decision has been taken by<br \/>\nrepresentation spondent No.1 till date. The petitioner was issued a<br \/>\nnotice dated 07.07.1999 informing him, and other concerned persons,<br \/>\nto remain present in the office of respondent No.3, who had impounded<br \/>\nthe said document under the provisions of Section-33 of the Bombay<br \/>\nStamp Act, 1958, on 09.07.1999. A case was registered and a reply was<br \/>\nfiled by the petitioner on 17.07.1999. The petitioner received<br \/>\nanother notice dated 28.07.2003, issued by respondent No.1, asking<br \/>\nhim to remain present in his office on 18.08.2003, in which there was<br \/>\nno reference to the reply dated 17.07.1999 filed by the petitioner.<br \/>\nThe petitioner, therefore, filed another reply on 08.08.2003. The<br \/>\ngrievance of the petitioner is that, though he has approached<br \/>\nrespondent No.1 several times and requested him for early hearing and<br \/>\ndecision of the case, there has been no response from the said<br \/>\nrespondent, and the case of the petitioner remains undecided, till<br \/>\ndate, though a period of about eight years has elapsed, after the<br \/>\npetitioner filed the second reply.\n<\/p>\n<p>3.\tMr.Jigar<br \/>\nM. Patel, learned advocate for the petitioner states, that the<br \/>\ninterest of justice would be met, if directions are issued to<br \/>\nrespondent No.1 to decide Case No.405\/1999, instituted in connection<br \/>\nwith the document in question, within a stipulated period of time.\n<\/p>\n<p>4.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed :\n<\/p>\n<p>\tRespondent<br \/>\nNo.1 shall consider and decide the case of the petitioner, being Case<br \/>\nNo.405\/1999, in accordance with law, within a period of four weeks<br \/>\nfrom the date of receipt of a copy of this order.
