SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/04\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\t Rule.\n<\/p>\n<p>Mr.Maulik Shelat, learned Advocate waives service of Rule on behalf<br \/>\nof the respondent. With the consent of the learned Advocates<br \/>\nappearing on behalf of the respective parties, present Revision<br \/>\nApplication is taken up for final hearing today.\n<\/p>\n<p>2.\t\tPresent<br \/>\nCivil Revision Application has been preferred by the applicants<br \/>\noriginal defendants challenging the impugned judgment and order dated<br \/>\n08.10.2009 passed by the learned 4th Fast Track Court,<br \/>\nRajkot in Civil Miscellaneous Application No.346 of 2009 in not<br \/>\ncondoning the delay of 309 days in preferring Regular Civil Appeal<br \/>\nchallenging the judgment and decree dated 13.10.2008 passed by the<br \/>\nlearned 11th Senior Civil Judge, Rajkot in Regular Civil<br \/>\nSuit No.28 of 1990.\n<\/p>\n<p>3.\t\tMr.Dipak<br \/>\nDave, learned Advocate for the applicants herein   original<br \/>\ndefendants has submitted that in the facts and circumstances of the<br \/>\ncase, more particularly learned Advocate appearing on behalf of the<br \/>\napplicants retired from the matter, therefore, the applicants were<br \/>\nnot aware of the judgment and decree passed by the learned Trial<br \/>\nCourt and therefore, in the facts and circumstances of the case,<br \/>\nlearned Appellate Court ought to have condoned delay while imposing<br \/>\nreasonable costs. Mr.Dave, learned Advocate for the applicants<br \/>\noriginal defendants has pointed out \/ relied upon decisions of the<br \/>\nHon&#8217;ble Supreme Court as well as of this Court in support of his<br \/>\nsubmission that normally sufficient cause in delay condonation<br \/>\napplication should be construed liberally.\n<\/p>\n<p>4.\t\tInitially,<br \/>\npresent Revision Application was opposed by Mr.Maulik Shelat, learned<br \/>\nAdvocate for the respondent herein   original plaintiff by<br \/>\nsubmitting that original defendants have not come out with clean<br \/>\nhands meaning thereby correct facts have not been pointed out in<br \/>\ndelay condonation application, therefore, it is requested not to<br \/>\nentertain present Revision Application. However, after making<br \/>\nsubmission when the Court expressed opinion that delay may be<br \/>\ncondoned on payment of costs quantified at Rs.15,000\/- (Rupees<br \/>\nFifteen Thousand only), Mr.Shelat, learned Advocate appearing for the<br \/>\nrespondent herein does not invite any further reasoned order.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of above, this Court is not assigning any reasoned order and in<br \/>\nthe facts and circumstances of the case more particularly to give one<br \/>\nopportunity to submit the case on merits in appeal, impugned judgment<br \/>\nand order dated 08.10.2009 passed by the learned 4th Fast<br \/>\nTrack Court, Rajkot in Civil Miscellaneous Application No.346 of 2009<br \/>\nis hereby quashed and set aside and delay caused in preferring<br \/>\nRegular Civil Appeal challenging the judgment and decree dated<br \/>\n13.10.2008 passed by the learned 11th Senior Civil Judge,<br \/>\nRajkot in Regular Civil Suit No.28 of 1990 is hereby condoned on<br \/>\ncondition that the applicant herein   original defendants shall pay<br \/>\nan amount of Rs.15,000\/- (Rupees Fifteen Thousand only) to respondent<br \/>\nherein   original plaintiff towards costs.  It is reported that<br \/>\napplicants herein have already deposited an amount of Rs.10,000\/-<br \/>\n(Rupees Ten Thousand only)  with the Registry of this Court pursuant<br \/>\nto the order dated 12.01.2010 passed by this Court and therefore, the<br \/>\napplicants herein are now required to pay balance amount of<br \/>\nRs.5,000\/- (Rupees Five Thousand only) to be deposited with the<br \/>\nlearned Appellate Court within a period of 3(three) weeks from today.<br \/>\nRegistry is also directed to transmit an amount of Rs.10,000\/-<br \/>\n(Rupees Ten Thousand only) deposited by the applicants herein<br \/>\npursuant to the order dated 12.01.2010 passed by this Court to the<br \/>\nlearned Appellate Court to be deposited in the appeal challenging the<br \/>\njudgment and decree passed by the learned Trial Court immediately.<br \/>\nOn deposit of aforesaid amount of Rs.5,000\/- (Rupees Five Thousand<br \/>\nonly) and on transfer of Rs.10,000\/- (Rupees Ten Thousand only) to<br \/>\nthe learned Appellate Court, it will be open for the respondent<br \/>\nherein to withdraw said amount and the learned Appellate Court is<br \/>\ndirected to make payment of Rs.15,000\/- (Rupees Fifteen Thousand<br \/>\nonly) to the respondent herein by Account Payee Cheque after proper<br \/>\nverification.  On deposit of Rs.5,000\/- (Rupees Five Thousand only)<br \/>\nto be deposited within stipulated time as stated above, learned<br \/>\nAppellate Court to decide and dispose of Regular Civil Appeal in<br \/>\naccordance with law and on merits.
