The petitioner claims to be a Philanthropist its
\nmain object appears to be promoting peace,
\neducation, social weifare, needy
\nThe said Society is established under
\nRegistration Act, 1975. The pehtitionedrhind ordrir’
\nabovesaid objects in Bangalore,  lands which
\nare reflected in the  ai.which  produced
\naiongwith this petition. \ufb02it  noticed that the<\/p>\n
sake deed  dfavdrgiurpdi4vo11e’P?r.A.t}ohn Bosco who is the President
\nof the petitioner Societgifj,’  Fr.A.John Bosco entered into a<\/p>\n
Joint Developrnent Agireeinent. A copy of which is produced as<\/p>\n
 it IJacurne’nt:,.A1\\\u00a7o.5A, The ‘petitioner Society it appears came to know<\/p>\n
about ‘t’his’v\u00ab,_:trar;sa’c.tion and pursuant to a resolution dated<\/p>\n
‘ ”   14. Zt’2.?'(d)\u20ac)7 _reso_h5ed that Fr.A.John Bosco who was the President<\/p>\n
 _ aiqthat  of time. did not have power to enter into a Memo of<\/p>\n
 .__Ui?iderstanding with the respondent. In the mean time, since<\/p>\n
  was interference by the respondent, the petitioner has filed<\/p>\n

a petition under Section 9 of the Arbitration and Conciiiation Act
\nin the Civil Court.\n<\/p>\n
2. Counsel for the petitioner submits that notices are
\nordered and the learned Trial Judge has granted statusrequo.<\/p>\n
Since the Joint Development Agreement envisaged<\/p>\n
clause, the present petition is med.\n<\/p>\n
3. Learned counsel appearing for
\nthat the purpose of estab1ishingV.th_e Society is
\ndocument dated 17.07.1987. He  subniits’&_Vthat  Stand in 7
\nquestion was purchased   President of<\/p>\n
the Society\ufb02and  iIi.diVidu.a1 capacity. He further submits
\nthat the said’ E’r.A.John not authorised by the Society<\/p>\n
to enter’ ‘into tire Joint’ Ilievelopment Agreement with the<\/p>\n

respon.;:1ent..Itoragreeiiupon the appointment of arbitrator to resolve<\/p>\n

 in   counsel appearing for the respondent submits<\/p>\n
‘t_*1:at.v}’\u00ab’reA;.John Bosco had purchased the-land in his individual<\/p>\n
b  and not as a President of the Society. He further submits<\/p>\n

that the Joint Development Agreement was also in his individual
\ncapacity and not as a President of the Society. Hence, he submits<\/p>\n
that the petitioner does not have locus to file this petition.<\/p>\n
5. I have perused the papers. It is to be noticedvthe
\nSociety has come into existence on 17.07.1987.
\ndispute that the property in question’  ”

\nre\ufb02ect that Fr.A.John Bosco hasgpurchasedg
\nPresident of the Society in questioVif\ufb01i’;’.V’,V\\:iv’}1at  is the
\nJoint Development  3;  “Development<\/p>\n
Agreement ithe”‘Societ_v”as’ vvell as by the respondent.
\nThe signatory to theJoint’*]\u00a7eite:1’o_pment Agreement is none other<\/p>\n
than Fr.A.John”–Bosco.fihesdocument is signed as the President<\/p>\n
p’Vt}1eV_p\u00e9stiti_o1:er Society_,__eEvience, i am of the View that it is not<\/p>\n
dopAen;i’o;<. the_vres'piondent to contend that the execution of the Joint<\/p>\n
 V Development' hggre\u00e9ement is in his individual capacity. Since the<\/p>\n
 dispute' has arisen between the petitioner as well as the<\/p>\n
_:"respondei1t  respect of certain terms to the agreement, I am of<\/p>\n
 the Zvieivithat an Arbitrator is required to be appointed to resolve<\/p>\n
"the"'dispute between the parties. it is also noticed that the<\/p>\n

petitioner issued a notice calling upon the respondent to agree
\nupon the appointment of an Arbitrator. The teamed counsel for
\nthe respondent submits that they have not received the notice.<\/p>\n
But however, as has been observed by the Apex Court in ptiadaetcase<\/p>\n
of Rashtriya Ispat Nigam Ltd. 8: Anr. Vs. <\/p>\n
Company reported in AIR 2006 SC 2800, that   ., <\/p>\n
under Arbitration Act is not mandatorya<\/p>\n
