PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/01\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present application<br \/>\nhas been filed by the applicant for grant of regular bail under sec.<br \/>\n439 of the Code of Criminal Procedure.\n<\/p>\n<p>2.\tThe applicant-accused is<br \/>\ncharged with having committed offences under sections 395, 120(B) and<br \/>\n114 of IPC and sec. 135 of the Bombay Police Act for which FIR, being<br \/>\nC.R. No. I-193\/2009, has been registered with Mehsana City Police<br \/>\nStation, Dist. Mehsana.\n<\/p>\n<p>3.\tLearned advocate Mr.<br \/>\nChaudhary submitted that the applicant-accused is not involved as<br \/>\nstated in the FIR  and also his name is not mentioned and the<br \/>\nspecific role is not attributed.  He submitted that at the most he is<br \/>\nsaid to have been at the downstairs and therefore there is no<br \/>\nidentification or any other evidence suggesting his involvement.  He<br \/>\ntherefore submitted that the present application may be allowed.\n<\/p>\n<p>4.\tLearned APP Mr. Jani<br \/>\nresisted the application. He referred to the statement of the<br \/>\nwitnesses and also the material and submitted that the charges are<br \/>\nfor offence under sec. 120B also and there was a conspiracy hatched,<br \/>\nwhich prima facie suggests involvement of the applicant accused.  He<br \/>\nsubmitted that the applicant accused was keeping a watch at the<br \/>\ndownstairs with other co-accused when the alleged offence of robbery<br \/>\nwas committed by the other co-accused.  Therefore, learned APP Mr.<br \/>\nJani submitted that the present application may not be allowed. He<br \/>\nreferred to the statement of the father of the applicant accused<br \/>\nwhere he is said to have handed over the amount which was part of the<br \/>\nrobbery. He therefore submitted that the present application may not<br \/>\nbe entertained.\n<\/p>\n<p>5.\tHaving heard<br \/>\nlearned advocate Mr. Chaudhary and learned APP Mr. Jani and having<br \/>\nregard to the nature of offence, the role attributed and also<br \/>\nconsidering the police papers and the other attending circumstances,<br \/>\nthe court is of the opinion that the resent application deserves to<br \/>\nbe allowed.\n<\/p>\n<p>6.\tThe application is<br \/>\naccordingly allowed.  The applicant-accused PATEL<br \/>\nBRIJESH NAVINBHAI is ordered to be released on bail<br \/>\nin connection with C.R. No. I-193\/2009 registered with  Mehsana City<br \/>\nPolice Station, Dist. Mehsana  on his executing a personal bond of<br \/>\nRs. 5,000\/- (Rupees Five Thousand only) with one solvent surety for<br \/>\nthe like amount to the satisfaction of the lower court and subject to<br \/>\nthe further conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue advantage<br \/>\nof his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper or<br \/>\npressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any manner<br \/>\ninjurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and order<br \/>\nand should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence before<br \/>\nthe concerned Police Station once in the first week of each calendar<br \/>\nmonth between 11.00 am to 2.00 pm till the trial commences.\n<\/p>\n<p>(f)\tfurnish the address of<br \/>\nhis residence to the investigating officer and also to the court at<br \/>\nthe time of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his passport,<br \/>\nif any, to the lower court, within a week.\n<\/p>\n<p>(h)\tIf there is any other<br \/>\noffence registered after this against the applicant accused, it will<br \/>\nbe a ground for the I.O. to move for cancellation of the appeal.\n<\/p>\n<p>7.\tIf breach of any of the<br \/>\nabove conditions is committed, the concerned Sessions Judge will be<br \/>\nfree to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case. It would be open to the<br \/>\ntrial court concerned to give time to furnish the solvency<br \/>\ncertificate, if prayed for.\n<\/p>\n<p>\tRule is made absolute.\n<\/p>\n<p>D.S. permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t(Rajesh H.
