No.21856 of 2008\n                           RAKESH KUMAR SINGH\n                                 Versus\n                             STATE OF BIHAR\n                              -----------\n<\/pre>\n<p>3   11.7.2008                   Heard the parties.\n<\/p>\n<p>                                The petitioner is an accused in a case under sections<\/p>\n<p>                364A\/34 of the Penal Code.\n<\/p>\n<p>                                The petitioner&#8217;s prayer for bail was earlier rejected by<\/p>\n<p>                this court on two earlier occasions.\n<\/p>\n<p>                                The involvement of the petitioner has come in the<\/p>\n<p>                statement of one Sita Ram who is a co-accused in this case.<\/p>\n<p>                                Learned counsel for the petitioner submits that whereas<\/p>\n<p>                other accused persons have been named by several other co-accused,<\/p>\n<p>                this petitioner has not been named by anyone except Sita Ram. It is also<\/p>\n<p>                submitted that Manoj Kumar Rai, Sanjay Pantel and Umesh Bhagat<\/p>\n<p>                have been granted bail by this court vide Cr.Misc. No. 20616\/2008 and<\/p>\n<p>                Cr. Misc. No. 17525\/2008 vide orders, dated 2.6.2008 and 14.5.2008<\/p>\n<p>                respectively. It is also submitted that the petitioner has a clean<\/p>\n<p>                antecedent and has produced a character certificate from the Block Dev.<\/p>\n<p>                Officer to show that there is no case pending against him.<\/p>\n<p>                                The petitioner has remained in custody for one year and<\/p>\n<p>                ten months.\n<\/p>\n<p>                                In the aforesaid facts the petitioner Rakesh Kumar Singh<\/p>\n<p>                is directed to be released on bail in S.T. No. 38\/2007 arising out of<\/p>\n<p>                Muzaffarpur (T) PS Case No. 253\/2006 on furnishing bail bond of<\/p>\n<p>                rupees ten thousand with two sureties of the like amount each to the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        satisfaction of the Addl.
