Heard     Shri    Rajesh       Kumar    Singh,<\/p>\n<p>                       learned    counsel    for   the    petitioner,     Shri<\/p>\n<p>                       Equbal Ahmad, learned counsel appearing on<\/p>\n<p>                       behalf of respondent nos.2 to 5 and Shri<\/p>\n<p>                       Vikas     Kumar,     learned      A.C.    to     learned<\/p>\n<p>                       Advocate General, who appears on behalf of<\/p>\n<p>                       the respondent no.1\/State.\n<\/p>\n<p>                                 The     petitioner,     who    superannuated<\/p>\n<p>                       with effect from 30.4.2001 as Professor of<\/p>\n<p>                       Patna     University,       has     prayed       for   a<\/p>\n<p>                       declaration that he is entitled to get his<\/p>\n<p>                       pension revised in view of Article 16 of<\/p>\n<p>                       the     Pension     Statute       read    with    State<\/p>\n<p>                       Government decision vide Resolution No.820<\/p>\n<p>                       dated 23.9.2009 and also for merger of 50%<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>dearness relief on his basic pension with<\/p>\n<p>effect    from       1.1.2005.           The    petitioner      has<\/p>\n<p>further           prayed           for         directing        the<\/p>\n<p>respondents to make payment of arrears of<\/p>\n<p>salary and earned leave.\n<\/p>\n<p>             So    far       as    first    two      reliefs    are<\/p>\n<p>concerned, the petition stands allowed in<\/p>\n<p>view    of    order         dated      3.12.2010       passed      in<\/p>\n<p>C.W.J.C.          No.3616         of   2010     (Dr.       Himanshu<\/p>\n<p>Bhushan            Vs.            Tilkamanjhi           Bhagalpur<\/p>\n<p>University and others) and other analogous<\/p>\n<p>cases.\n<\/p>\n<p>             So    far       as    arrears      of    salary    and<\/p>\n<p>amount of earned leave are concerned, the<\/p>\n<p>petitioner         is       granted      liberty      to    file    a<\/p>\n<p>proper       representation              before        respondent<\/p>\n<p>no.4\/the Registrar, Patna University within<\/p>\n<p>a period of six weeks from today. If such<\/p>\n<p>representation              is     filed,      the     respondent<\/p>\n<p>no.4 is directed to examine the same and<\/p>\n<p>pass     appropriate               order       redressing       the<\/p>\n<p>grievance of the petitioner within a period<\/p>\n<p>of three months from the date of filing of<\/p>\n<p>such representation. In case of refusal, in<\/p>\n<p>respect of arrears of salary and payment of<\/p>\n<p>leave     encashment              amount,      the     respondent<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>        no.4 is directed to pass a speaking order<\/p>\n<p>        within aforesaid time.\n<\/p>\n<p>                 With            above       observation         and<\/p>\n<p>        direction, the petition stands disposed of.<\/p>\n<p>                 It     is       made    clear      that    if   the<\/p>\n<p>        respondent no.4 considers the claim of the<\/p>\n<p>        petitioner as genuine, he is required to<\/p>\n<p>        pass   order    for       clearing    the    dues    within<\/p>\n<p>        three months from the date of filing of<\/p>\n<p>        such representation.
