DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/06\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that investigation<br \/>\n\tis over and charge sheet is filed.  It is further submitted<br \/>\n\tthat the applicant is elder brother-in-law of the<br \/>\n\tdeceased and other co-accused are already enlarged on bail, except<br \/>\n\thusband and father-in-law of the deceased.  Learned advocate relying<br \/>\n\ton the agreement submitted that the deceased had married to one<br \/>\n\tDipak, son of the applicant of Criminal Misc. Application No.7745 of<br \/>\n\t2011 and stayed with him for about 2 years prior to her lawful<br \/>\n\tmarriage with Dipak.  It is further submitted that allegations<br \/>\n\tlevelled in the FIR are causing mental and physical torture to the<br \/>\n\tdeceased and the deceased was pressurized to part with the land<br \/>\n\towned by her uncle in favour of the applicant, who is alleged to be<br \/>\n\trunning a school.  It is further submitted that in fact only part of<br \/>\n\tthe land belonging to the relatives of the deceased was handed over<br \/>\n\tto the applicant pursuant to the agreement and monthly rent of<br \/>\n\tRs.5,000\/- is being paid.  It is further submitted that considering<br \/>\n\tthe nature of allegations and role attributed to the applicant, by<br \/>\n\timposing suitable conditions,  the applicant may be enlarged on<br \/>\n\tbail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase, prima facie, allegations with regard to pressurizing and<br \/>\n\ttorturing the deceased by the applicant &#8211; accused so as to<br \/>\n\tpart with the land in question on which school is situated and<br \/>\n\toperations, are not born out.  At the same time only part of the<br \/>\n\tland was given to the applicant by relatives of the deceased as per<br \/>\n\tthe recital in the agreements.  However, no complaint was made by<br \/>\n\tthe deceased about allegations pertaining to the land on which<br \/>\n\tschool is running.  Therefore,  taking into consideration the facts<br \/>\n\tof the case, nature of allegations, role attributed to the accused<br \/>\n\tand punishment prescribed for the alleged offences coupled with the<br \/>\n\tfact that charge sheet is filed,<br \/>\n\twithout discussing the evidence in detail, at this stage, I am<br \/>\n\tinclined to enlarge the applicant on bail  in connection with<br \/>\n\tC.R.No.I-6\/2011 of Mahila Police Station, District Rajkot for the<br \/>\n\toffences punishable under sections 306, 498A, 504 and 114 of the<br \/>\n\tIndian Penal Code, on furnishing   bond of Rs.10,000\/- (Rupees ten<br \/>\n\tthousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m till commencement of the trial.\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
