Asthavadi for the petitioner.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the petitioner invited attention of the Court  to order<br \/>\nunder challenge passed by the Employees Provident Fund Appellate<br \/>\nTribunal in ATA No. 10[5] of 2008, relevant part of which reads as<br \/>\nunder:-\n<\/p>\n<p>&#8220;Thus<br \/>\nin view of the discussion held above, the order of the authority<br \/>\ncannot be sustained. Hence, ordered, the matter is remanded back to<br \/>\nthe PF authority to assess the dues @ 17% {inclusive of interest}.<br \/>\nThe appellant is also directed to appear before the PF authority<br \/>\nwithin one month of receipt of this order. If the appellant fails to<br \/>\nappear the authority may decide the matter as per law. Copy of order<br \/>\nbe sent to the parties. File be consigned to record room.&#8221;\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the petitioner argued on assumption that the authorities<br \/>\nwill calculate dues @ 17% (inclusive of interest) and it will be<br \/>\nhigher than the one at which  earlier it was calculated. This<br \/>\napprehension is on surmises and, therefore, the contention is not<br \/>\naccepted.\n<\/p>\n<p>\tAt<br \/>\nthe request of learned advocate for the petitioner, it is clarified<br \/>\nthat in the event, the petitioner is aggrieved by the calculation<br \/>\nundertaken by the authority  on its own interpretation of this order,<br \/>\nit will be open for the petitioner to challenge the same in<br \/>\naccordance with law.\n<\/p>\n<p>\tWith<br \/>\nthis observation, the petition is disposed of.
