SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/10\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner-Corporation has prayed for an appropriate writ, order<br \/>\nor direction quashing and setting aside the impugned judgement and<br \/>\naward dated 02\/03\/2001 passed by the learned Presiding Officer,<br \/>\nLabour Court No. 3, Surat in Reference Application No. 148\/1993 by<br \/>\nwhich the Labour Court has directed the petitioner to reinstate the<br \/>\nrespondent without back wages but without continuity of service.\n<\/p>\n<p>2.\tThough<br \/>\nserved, nobody  appears on behalf of the respondent.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri P.G. Desai, learned Senior advocate assisted by Shri G.M.<br \/>\nJoshi, learned advocate appearing on behalf of the petitioner  and<br \/>\nconsidering the impugned judgement and award and the facts so stated<br \/>\nin the petition it appears that the petitioner received an<br \/>\napplication for badli worker on 08\/07\/1985 in the name of Smt.<br \/>\nJashuben Karsanbhai Padaya and, thereafter, the said applicant was<br \/>\ncalled for interview and was appointed on the said post.  Thereafter,<br \/>\nvide letter dated 19\/09\/1991 she was appointed as safai kamdar from<br \/>\n19\/09\/1991. It appears that thereafter the original Jashuben<br \/>\nKarsanbhai Padaya lodged complaint before the police alleging that<br \/>\nthe respondent joined the service in the Corporation by using her<br \/>\nname and has fraudulently got the appointment and she has cheated the<br \/>\nCorporation.\n<\/p>\n<p>4.\tIt<br \/>\nis the case on behalf of the petitioner that having come to the<br \/>\nknowledge of the Corporation the above fact, the Corporation called<br \/>\nthe respondent for personal hearing on 20\/02\/1993 for ascertaining<br \/>\nthe true facts of the allegations and whether the respondent was the<br \/>\nsame Jashuben Karsanbhai Padaya, who had applied for the post and she<br \/>\nwas also asked to produce necessary documents.  It appears that the<br \/>\nrespondent confessed that she is not the one who had applied with the<br \/>\nCorporation as Jashuben Karsanbhai Padaya and, therefore, from<br \/>\n22\/02\/1993 she herself discontinued to work with the Corporation.<br \/>\nThereafter, the respondent raised an industrial dispute before the<br \/>\nLabour Court Commissioner, which was referred the Labour Court,<br \/>\nSurat, which was numbered Reference Application No. 148\/1993 mainly<br \/>\non the ground that before terminating the service of the respondent<br \/>\nno departmental inquiry has been initiated and no criminal complaint<br \/>\nhas been filed. The Labour Court passed an order to reinstate the<br \/>\nrespondent, however denied the back wages.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe aforesaid judgement and order  and the facts narrated<br \/>\nhereinabove, it appears that there was no termination by the<br \/>\npetitioner at all and on the contrary having faced with the situation<br \/>\nand the allegation and having being caught the respondent herself<br \/>\nstopped attending the duties and, therefore,  there is no termination<br \/>\nat all for which any procedure was required to be followed as<br \/>\nrequired under the provisions of the Industrial Disputes Act.  Under<br \/>\nthe circumstances and in the facts and circumstances of the case, the<br \/>\nLabour Court has materially erred in partly allowing the Reference<br \/>\ndirecting the petitioner to reinstate the respondent to her original<br \/>\npost i.e. as safai kamdar.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above, the present petition succeeds.  The impugned order<br \/>\ndated 02\/03\/2001 passed by the learned Presiding Officer, Labour<br \/>\nCourt No. 3, Surat in Reference Application No. 148\/1993 is hereby<br \/>\nquashed and set aside.  Rule is made absolute.
