Whether the judgment should be reported in the Digest ?\n                               ***\n\n\nAjay Tewari, J.\n<\/pre>\n<p>                   This petition has been filed challenging the notice<\/p>\n<p>(Annexure    P-13) calling upon the petitioner to deposit an amount of<\/p>\n<p>Rs. 49, 04,127\/- on the ground that a load of 4904.127 KW was detected<\/p>\n<p>being unauthorised load in the mill of the petitioner. As per his notice the<\/p>\n<p>following was found by the inspection team:-<br \/>\n<span class=\"hidden_text\"> CWP No. 7299 of 1993                 2<\/span><\/p>\n<blockquote><p>            (1)   1106.325 KW        Total running load checked by<br \/>\n                                     Enforcement Staff<\/p>\n<p>            (2)   3187.500 KW        Connected     load on T.G. Set<\/p>\n<p>            (3)   2226.330 KW Connected standby load on T.G. Set<br \/>\n                  6520.155 KW Total<br \/>\n                  1616.028 KW (-) PSEB Sanctioned Load<\/p>\n<p>                  4904.127 KW            Excess Load<\/p>\n<p>As per commercial circular No. 12 of 89 connected load is defined as<\/p>\n<p>follows:-\n<\/p><\/blockquote>\n<blockquote><p>                  Connected Load:\n<\/p><\/blockquote>\n<blockquote><p>                         The connected load means the sum of the rated<br \/>\n                  capacities of all the energy consuming apparatus in the<br \/>\n                  consumer&#8217;s installation. This shall not include the stand<br \/>\n                  by or spare energy consuming apparatus installed<br \/>\n                  through the change over witch provided requisite prior<br \/>\n                  permission had been accorded by the competent authority<br \/>\n                  in the Board as per provisions of NOTE (iii) below :-\n<\/p><\/blockquote>\n<blockquote><p>                        NOTE:-\n<\/p><\/blockquote>\n<blockquote><p>                               (iii) The consumer shall be allowed the<br \/>\n                        change over switch with the permission of<br \/>\n                        competent authority, subject to the conditions that<br \/>\n                        the particular gadget\/machinery supposed to be<br \/>\n                        operated through a particular motor whose change<br \/>\n                        over switch is deployed should be specified in the<br \/>\n                        test report itself and verified as such at the time of<br \/>\n                        release of load and the bigger of the two motors<br \/>\n                        shall be taken into account while computing the<br \/>\n                        connected load.&#8221;<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                  It is not disputed that with regard to the same dispute<\/p>\n<p>earlier CWP No. 370 of 1993 was filed. The same had been disposed of<\/p>\n<p>with the following observations:-\n<\/p><\/blockquote>\n<blockquote><p>                  &#8220;For the reasons recorded above, the order Annexure P\/8<br \/>\n                  is quashed, leaving the respondent\/Board to pass<br \/>\n                  appropriate order, if so advised, and the petitioner would<br \/>\n                  be at liberty to challenge the same, if required. Since the<br \/>\n<span class=\"hidden_text\"> CWP No. 7299 of 1993                 3<\/span><\/p>\n<p>                  electricity supply of the petitioner was disconnected on<br \/>\n                  passing of the order Annexure P\/8, we direct the<br \/>\n                  respondent-Electricity Board to reconnect it forthwith<br \/>\n                  which would of course be subject to the final order to be<br \/>\n                  passed by the respondents as required under the circular.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                  It was thereafter that the impugned notice was issued.<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>             The dispute centers around the permissibility of adding the<\/p>\n<p>load connected on the T.G. Set viz. 3187.500 KW and the standby load<\/p>\n<p>i.e.2226.330 KW.       As regards the second component in the above<\/p>\n<p>mentioned writ petition the Division Bench had found as follows:-<\/p>\n<\/blockquote>\n<blockquote><p>                               &#8220;As per circular Annexure R\/1, for the<br \/>\n                         purposes of charging for the excess load, the load<br \/>\n                         of the standby machinery was to be excluded.<br \/>\n                         However, in the order Annexure P\/8 the load of the<br \/>\n                         standby apparatus to the extent of 2226.330 KW<br \/>\n                         was included.    This is also in violation o the<br \/>\n                         circular mentioned above and the demand raised<br \/>\n                         through order Annexure P\/8 is, thus, not in<br \/>\n                         accordance with the circular aforesaid and, cannot<br \/>\n                         be sustained in law.&#8221;<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>            This finding regarding the standby load is thus binding on this<\/p>\n<p>court and consequently it is held that the addition of 2226.330 KW was not<\/p>\n<p>permissible. However, with regard to the first component viz. Connected<\/p>\n<p>load on T.G. Set, this Court on 21.8.2008 had recorded as follows:-<\/p>\n<\/blockquote>\n<blockquote><p>                         &#8220;Arguments in part heard.\n<\/p><\/blockquote>\n<blockquote><p>                         The dispute in this petition primarily relates to the<br \/>\n                  question, whether with the aid of a device called a bus<br \/>\n                  coupler, inter transferability of load could be effected<br \/>\n                  between the captive generation apparatus of the<br \/>\n                  petitioner and the energy supplied by the respondent-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> CWP No. 7299 of 1993                  4<\/span><\/p>\n<blockquote><p>                   board. This is a disputed question of fact.\n<\/p><\/blockquote>\n<blockquote><p>                               At this stage learned counsel for the<br \/>\n                   petitioner has very fairly stated that he would accept the<br \/>\n                   decision of the Dispute Settlement Committee of the<br \/>\n                   respondent-board on this aspect of the matter. Let the<br \/>\n                   Dispute Settlement Committee of the respondent-board,<br \/>\n                   after hearing both the parties, give an opinion on the<br \/>\n                   question whether the bus coupler installed         by the<br \/>\n                   petitioner would permit inter-transferability of the load<br \/>\n                   between the Turbo Generator Set of the petitioner and<br \/>\n                   the PSEB. Let representatives of both the parties appear<br \/>\n                   before the Dispute Settlement Committee in this regard<br \/>\n                   on 28.8.2008.\n<\/p><\/blockquote>\n<blockquote><p>                         The matter is adjourned for two weeks i.e.<br \/>\n                   8.9.2008.\n<\/p><\/blockquote>\n<blockquote><p>                         Copy of this order be given to both the learned<br \/>\n                   counsel under the signatures of the Reader of this Court.&#8221;<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            The said committee submitted its report wherein it has been<\/p>\n<p>found that with the aid of the bus coupler the inter-transferability of load<\/p>\n<p>was possible. In view of the statement dated 21.8.2008 it is, therefore, held<\/p>\n<p>that the addition on account of the load connected on the T.G. Set cannot be<\/p>\n<p>faulted with and is upheld.\n<\/p><\/blockquote>\n<blockquote><p>            The writ petition is disposed of in the above terms.<\/p>\n<p>April 01 , 2009.
