When the\n\nbicycie yvas the extreme left side of SM.\n\nRoad, near V_V'Fa,thi:A1'i_aV"Church, a car bearing N0.KA -\n\n  peing""dVriven by its driver, in a rash and\n\n   Rdnianner, came from behind and dashed\n\nagainst~ thheddbicycle of the deceased. Due to the impact,\n\n the tudeceased sustained grievous injuries and\n\n  V'si1c'curnbed to the same in Command Hospital at 6:45\n\nd V .I%A.M. on the same da\n'_____W_,__,_,,,....\n\n\n\n3. It is the case of the appellant that, the\ndeceased was aged about 57 years, working as Warrant\nOfficer in Indian Air Force at Airforce Technical.g'C--ollege\n\nand drawing salary of ?14,776\/-- per \n\nincome tax assessee. It is her further.c'ase:.A_1that.,." \n\naccount of his untimely death,  it\n\nhaywire and she has lostgthe 'life'*partne1f.. \n\nsecurity and therefore,  to"-ldedcompensated\nadequately.\n\n  of the deceased in the\naccident,<_the  her two children, who are\n\nrespondents" 3_'and_ V\u00e9fdlherein, filed the claim petition\n\n Ab'ei;or\u00a7,,th;'e,_Trihun'alV seeking compensation of a sum of\n\n  the respondents 1 and 2 herein.\n\n'I'h__e saiddijclaim petition had come up for consideration\n\n pp before. the Tribunal on 4% March 2005. The Tribunal,\n\n' --..V"aft.eir considering the relevant material available on file\n\nRand after appreciation of the oral and documentary\n\nevidence, allowed the 'm petition in part, awarding a\nWWW".\n\nI'\n!\n\n\n\nsum of ?'5,81,000\/- with interest at 6% per annum from\nthe date of petition till the date of deposit. Being\naggrieved by the quantum of compensation awarded by\n\nthe Tribunal, on the ground that is\n\ninadequate, the appellant is in appeal   \n\nseeking enhancement of cornpe1nsatio1_;7.."'.gg '1 he ' V t\n\n5. Out of which,\n\n:'~"'"'\u00b0""""'"M'w'm"\nt\n\n\n\nprofessional tax and income tax are to be deducted.\nAccordingly. if a total sum of ?l8.200\/-- is deducted\nunder the said heads, the net income comes to\n\n31,59,112\/-- per annum. The app1'0p1'iat_e..__lintill\u00a3l1;lliiE1'\n\napplicable. having regard to the age of  \n\n'9' as per Sarla VerIna's case'-4.'  'regard '4\n\nnumber of dependents, 1V,xs"3fd \n\ndeducted from ?I,59,ll\u00a7'\/El' and lithe said\ndeduction, it comes annum. In the\n\nlight of the well settledv:.law'V--1ai,d  this Court, in\n\nthe pcaseagsc  Iiiiiiaill and others Vs. Accordingly,\n\n   deceased was left with another three years of\n\nser__'lVic_e,~  multiplier of '3' has to be applied for a sum\n\n of ?i,.o6,075\/--, which comes to ?3,18,225\/-- and\n\n uptheireafter, after deducting 50% from "('l,06,075\/-,\n\n '' Nlmultiplier of '6' has to be adopted, which comes to\n\n?'3,l8,225\/--. Accordin\u00e9lg\ufb02the total loss of dependency\n[I ##2##\n\n\n\nworks out to 33,18,225\/- (i.e. 31,06,075\/--~ X'3'} plus\n33,18,225\/- (i.e. ?1,06,075\/~ x'6'], which comes to\n?6,36,450\/-- as against ?5,56,000\/-- awarded by\n\nTribunal.\n\n7. In the light of the facts and circumstances of\n\nthe case, as stated abo\\%t;'1e appeal filed by appellants\nIf \ufb02\n\n{\n\n\n\nis allowed in part.
