KRUTI M\nSHAH for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.0\tThis<br \/>\napplication is filed by the applicant for transfer of the proceedings<br \/>\nof Hindu Marriage Petition No. 277 of 2009 pending before the Family<br \/>\nCourt at Surat to Family Court at Vadodara.\n<\/p>\n<p>2.0\tThe<br \/>\napplicant is the husband of the respondent  who has stated that he<br \/>\nhas been given threat.  The applicant stated in the affidavit that he<br \/>\nhas been given threat by family members\/relative of the<br \/>\nrespondent-wife and inspite of informing to the police authorities<br \/>\nabout the same, the police authority is not taking any note in that<br \/>\nregard. Therefore, the applicant has prayed for transfer of the<br \/>\nproceedings.\n<\/p>\n<p>3.0\tThe<br \/>\nCriminal Misc. Application No. 12502 of 2010 preferred by the<br \/>\napplicant and this Court passed order on 21.12.2010 and dismissed the<br \/>\nsame. Hence, the ground of threat given by the family<br \/>\nmembers\/relatives from the respondent-wife cannot be a ground for<br \/>\ntransferring the proceedings. Apart from that an assurance is given<br \/>\nby learned advocate for the respondent that there will not be any<br \/>\nthreat given by the respondent to the applicant.\n<\/p>\n<p>4.0\tIt<br \/>\nis made clear that if there is threat given to the applicant from the<br \/>\nrespondent and if the applicant makes a complaint at the nearest<br \/>\npolice station in Surat that there is danger to the life of the<br \/>\napplicant, the police protection will be given.\n<\/p>\n<p>5.0\tIn<br \/>\nview of the above, the application stands disposed of.\n<\/p>\n<p>6.0\tLearned<br \/>\nadvocate for the applicant stated that he has moved another<br \/>\napplication for transfer of the proceedings under Section 125 of the<br \/>\nCriminal Procedure Code in respect of another complaint.
