MOHANAN, J.\n              ----------------------------------------\n               Bail Application No. 2070 of 2010\n              -----------------------------------------\n             Dated this the 16th day of April, 2010\n\n                             O R D E R\n<\/pre>\n<p>      In this Petition filed under Sec. 438 Cr.P.C. the petitioner,<\/p>\n<p>who is the 2nd accused in Crime No.29\/2010 of Thalappuzha<\/p>\n<p>Police Station in Wayanadu District for offences punishable under<\/p>\n<p>Sections 341, 323, 294(b), 447, 353 r\/w 34 I.P.C., seeks<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>      2.   I have heard the learned counsel for the petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.   Having regard to the nature of the allegations levelled<\/p>\n<p>against the petitioner and the other circumstances of the case, I<\/p>\n<p>am inclined to grant anticipatory bail to the petitioner.<\/p>\n<p>Accordingly, a direction is issued to the officer-in-charge of the<\/p>\n<p>police station concerned to release the petitioner on bail for a<\/p>\n<p>period of one month in the event of his arrest in connection with<\/p>\n<p>the above case on his executing a bond for Rs.25,000\/- (Rupees<\/p>\n<p>Twenty Five Thousand only) with two solvent sureties each for<\/p>\n<p>the like amount to the satisfaction of the said officer and subject<\/p>\n<p>BA No.2070 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>to the following conditions:\n<\/p>\n<blockquote><p>           1.The    petitioner    shall  report   before   the<br \/>\n             Investigating Officer between 9 a.m. and 11<br \/>\n             a.m. on all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><p>           2.The petitioner shall make himself available for<br \/>\n             interrogation as and when       required by the<br \/>\n             Investigating Officer.\n<\/p><\/blockquote>\n<blockquote><p>           3.The petitioner shall not influence or intimidate<br \/>\n             the prosecution witnesses nor shall he attempt<br \/>\n             to tamper with the evidence for the prosecution.\n<\/p><\/blockquote>\n<blockquote><p>           4.The petitioner shall not commit any offence<br \/>\n             while on bail.\n<\/p><\/blockquote>\n<blockquote><p>           5.The   petitioner   shall  surrender before    the<br \/>\n             Magistrate concerned and seek regular bail in<br \/>\n             the meanwhile.<\/p><\/blockquote>\n<p>     If the petitioner commits breach of any of the above<\/p>\n<p>conditions, the bail granted to him shall be liable to be cancelled.<\/p>\n<p>            This application is allowed as above.<\/p>\n<p>                                        V.K.MOHANAN,<br \/>\n                                           JUDGE<\/p>\n<p>ttb<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Shaheer Shan vs State Of Kerala on 16 April, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2070 of 2010() 1.
