There is no any criminal antecedent<br \/>\nagainst the applicant. He also submitted that the accused No.1 is<br \/>\nenlarged by this Court on 22.6.2010 passed in Criminal Misc.<br \/>\nApplication No.6334 of 2010 and therefore, on parity ground also, the<br \/>\napplicant is required to be granted anticipatory bail. In view of the<br \/>\naforesaid facts and circumstances of the case, it is a fit case to<br \/>\nrelease the present applicant on anticipatory bail.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>A.J. Desai, learned Additional Public Prosecutor representing the<br \/>\nState submitted that considering the role attributed to the applicant<br \/>\nwhich is reflected in the FIR at Annexure-A to the application and<br \/>\nthe nature of offences in which the applicant is involved as well as<br \/>\nthe manner in which the offences are committed by the applicant, the<br \/>\napplication deserves to be rejected.\n<\/p>\n<p>\tHaving<br \/>\nconsidered the rival submissions and on perusal of the FIR at<br \/>\nAnnexure-A to the petition, the petitioner is booked for the offences<br \/>\npunishable under Sections 363, 366 and 376 of the Indian Penal Code.<br \/>\nIn view of the above facts and circumstances of the case and without<br \/>\nentering into merits of the case, I am inclined to exercise my<br \/>\ndiscretion in favour of the applicant.\n<\/p>\n<p>\tIn<br \/>\nthe event of arrest of the petitioner in connection with CR No. I<br \/>\n277 of 2009 registered with Katargam Police Station, Surat for the<br \/>\noffences punishable under Sections 363, 366 and 376 of the Indian<br \/>\nPenal Code, he shall be released on bail on his executing a bond of<br \/>\nRs.10,000\/- [Rupees ten thousand only] with one surety of the like<br \/>\namount on the following conditions that he shall:\n<\/p>\n<p>[a]\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at the concerned Police Station on 23.7.2010 at<br \/>\n11:00 a.m.<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d]\tat<br \/>\nthe time of execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot<br \/>\nleave India without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot<br \/>\nobstruct or hamper the police investigation and not play mischief<br \/>\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n<p>\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>\tThis<br \/>\norder will hold good, if the petitioner is arrested at any time<br \/>\nwithin 90 days from today.  The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the petitioner to make a fresh<br \/>\napplication for being enlarged on bail in usual course, when it comes<br \/>\nup before the competent Court, will be decided in accordance with<br \/>\nlaw, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>\tWith<br \/>\nthese directions, this petition is allowed.
