The District Superintendent of Education- cum- Co-ordinator,\n              Bihar Education Project Nalanda, Biharsharif\n           5. The Circle Officer\/ Block Development Officer, Rajgir, Nalanda,\n              Biharsharif\n           6. Bihar Prarambhik Vidyalaya Shiksha Samiti, Newly constructed\n              School, Ashoknagar, Rajgir, Nalanda, Biharsharif, through its\n              Secretary, namely, Kapildeo Prasad\n                                  -----------\n<\/pre>\n<p>04\/   16.12.2010               Heard learned counsel for the petitioner and the<\/p>\n<p>                     counsel for the State and the Private Respondent no.6, the<\/p>\n<p>                     Secretary, Bihar Prarambhik Vidyalaya Shiksha Samiti,<\/p>\n<p>                     Rajgir, Nalanda.\n<\/p>\n<p>                               2. Dispute raised in this petition is that school<\/p>\n<p>                     building has been raised by Respondent no.6 over plot no.<\/p>\n<p>                     2549, appertaining to Khata No. 333 of Mohalla Ashok<\/p>\n<p>                     Nagar, Rajgir, which is Gairmazarua Aam Rasta Land and<\/p>\n<p>                     Respondent no.6 has no authority to raise any construction<\/p>\n<p>                     over the same.\n<\/p>\n<p>                               3. It is submitted by the counsel for Respondent<\/p>\n<p>                     no.6 that petitioner himself has encroached portion of the<\/p>\n<p>                     aforesaid Gairmazarua Aam Rasta Land.<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>                   4. Having heard counsel for the parties, I direct<\/p>\n<p>         the Sub-Divisional Officer, Rajgir to consider the<\/p>\n<p>         submission noted above, as it is said that a petition under<\/p>\n<p>         Section 133 Cr.P.C. for removal of encroachment from the<\/p>\n<p>         aforesaid Gairmazarua Aam Rasta Land is pending before<\/p>\n<p>         him, in accordance with law, as early as possible, in any<\/p>\n<p>         case within two months from the date of receipt\/<\/p>\n<p>         production of a copy of this order before the Sub-<\/p>\n<p>         Divisional Officer, Rajgir.\n<\/p>\n<p>                   5. It is made clear that any encroachment over<\/p>\n<p>         the aforesaid Gairmazarua Aam Rasta Land, may be by<\/p>\n<p>         the school or by the petitioner or by Sri Kapildeo Prasad,<\/p>\n<p>         the Secretary be removed within the same time.<\/p>\n<p>                   6.
