\n\tMr.Mihir Joshi, learned Senior Advocate with Mr.Sandip Singhi,
\n\tlearned advocate appearing for Singhi & Company for the
\n\tplaintiff.  The learned Senior Advocate submitted that the order of
\n\tarrest of MV ?SKOMODO?? together with her hull, tackle, machinery,
\n\tengines, bunkers, paraphernalia and appurtenance is required to be
\n\tpassed against the claim of the plaintiff in Admiralty Suit No.6 of
\n\t2008. After hearing learned counsel for the plaintiff, it appears
\n\tthat there is a claim of loss and damages of Rs.2,97,21,868\/- to the
\n\tplaintiff being the amount claimed by the plaintiff from the
\n\tdefendant Vessel.  This Court has gone through the plaint and after
\n\thearing the learned counsel for the plaintiff, it prima facie
\n\tappears that the plaintiff is entitled to claim security from the
\n\towners’ of MV ?SKOMODO??, the learned advocate for the plaintiff
\n\taccordingly submitted that unless MV ?SKOMODO?? together with her
\n\thull, tackle, machinery, engines, bunkers, paraphernalia and
\n\tappurtenance is arrested, the plaintiff would suffer irreparable
\n\tloss in the event MV ?SKOMODO?? is permitted to sail away without
\n\tfurnishing the security, as the plaintiff will have no scope to
\n\trealize the amount.  Considering the prima facie case established by
\n\tthe plaintiff, this Court is of the view that the plaintiff will be
\n\tput to irreparable loss and injury and therefore, it is necessary to
\n\tarrest MV ?SKOMODO?? presently lying in the waters of Port of
\n\tDahej Harbour Infrastructure Limited, Dahej, Gujarat in connection
\n\twith the claim raised in Admiralty Suit No.6 of 2008.\n<\/p>\n
\tThis
\n\tCourt does order that the Registrar of this Court do issue an order
\n\tfor arrest of MV ?SKOMODO?? together with her hull, tackle,
\n\tmachinery, engines, bunkers, paraphernalia and appurtenance at
\n\tpresent lying in the waters of  Port of Dahej Harbour Infrastructure
\n\tLimited, Dahej, Gujarat and that the warrant of arrest be executed
\n\tat any time of the day or night or on Sundays or Holidays and this
\n\tCourt does further order that the Port Officer at Bharuch and the
\n\tSuperintendent of Customs at Port of Dahej Harbour Infrastructure
\n\tLimited, Dahej, Gujarat do effect the arrest of MV ?SKOMODO?? at
\n\tPort of Dahej Harbour Infrastructure Limited, Dahej, or such other
\n\tplace where ever she may be within the territorial waters of India
\n\tand this Court does further order that if Defendant Vessel and\/or
\n\tthose interested in her deposit in this Court a sum of
\n\tRs.2,97,21,868\/- together with interest @ 15% per annum from the
\n\tdate of filing of the suit till payment\/realization to the
\n\tsatisfaction of the Registrar of this Court as security towards the
\n\tsatisfaction of the plaintiff’s claim in the suit, the said warrant
\n\tof arrest shall not be executed against the defendant.\n<\/p>\n
\tThe
\n\tPort Officer and the Superintendent of Customs, at Bharuch, Gujarat
\n\tare directed to arrest the vessel MV ?SKOMODO?? at present lying
\n\tat  Port of Dahej Harbour Infrastructure Limited, Dahej, Gujarat
\n\twithin the territorial waters of India and to keep the vessel under
\n\tarrest until further orders of this Court.  It is further ordered
\n\tthat the Port Officers and the Superintendent of Customs at Bharuch,
\n\tGujarat shall render all assistance to the plaintiff in effecting
\n\tthe arrest of warrant on the vessel MV ?SKOMODO??.\n<\/p>\n
\tIt
\n\twill be open for the learned Advocate for the plaintiff to
\n\tcommunicate the above order by fax at their own cost and the
\n\tauthorities are directed to act on fax copy of the order.\n<\/p>\n
\tThe
\n\tundertaking of the plaintiff be filed as per Code of Civil
\n\tProcedure, 1908.  Such undertaking be filed by the plaintiff on or
\n\tbefore 5th September, 2008.\n<\/p>\n
\tNotice
\n\tto the defendants returnable on 15th September, 2008.  It
\n\tis made clear that, it will be open for the defendants to approach
\n\tthis Court even prior to the returnable date, by giving 48 hours
\n\tadvance notice to the plaintiff and\/or its Advocates for necessary
\n\tmodification of this order.\n<\/p>\n
\tOffice
\n\tis directed to serve the warrant of arrest on the Master of the
\n\tVessel MV ?SKOMODO?? through her agent and send a copy thereof to
\n\tthe Port Officer and the Superintendent of Customs, at Bharuch,
\n\tGujarat.\n<\/p>\n
